Just in from USCIS folks. People who want to adjust status while in the United States must now return to their home country and obtain their green cards there. You read that right - even people who entered the United States legally (as temporary workers, tourists, students, etc) and later on either get married to a U.S. Citizen or are petitioned by a U.S. employer must now return to their home country and obtain their green cards there. According to USCIS, adjustments of status while in the United States will be granted only in "extraordinary circumstances". Stay tuned folks as I am sure this new USCIS rule will be challenged in the courts.

Well folks, it just gets better and better. Last Friday, USCIS released a memo regarding Naturalization applicants and determination of their good moral character. Normally, GMC only meant that they are generally, good people, even though they may have had a few traffic tickets before, or even had DUI but paid the fines and had it expunged.

Unfortunately now, having traffic tickets or a DUI can count as reasons to deny applicants who wish to Naturalize. Not only that, but once their Naturalization applications have been denied, they may (and I use this term with a grain of salt) receive notices from USCIS rescinding their lawful permanent residence (green card).

As such, if you are considering to file for Naturalization, please make sure you consult with a qualified Immigration lawyer first to make sure that you are not going into this new rabbit hole that the administration has created.

Ok everyone, things are getting pretty bad out there. If you are undocumented, please stay away from places where there is a concentration of undocumented immigrants as ICE definitely targets those first.

If you are a green card holder and are considering traveling soon, postpone it. Reports have been coming in of green card holders being detained for no apparent reason, but what we know is that if you have a prior criminal case, even if it has been resolved, your permanent resident status is at risk of being revoked and you may be subject to deportation.

This administration is invoking fear on everyone and as an Immigration lawyer, I find it reprehensible that in a society like ours in this present day and time that this is happening.

Hang in there everyone, this is going to be a bumpy ride but I still have faith in our democratic system. We will fight, and we will prevail over this injustice.
