I am seeing more and more families with older trust plans that were never reviewed after major tax law changes.

Many people do not realize that estate and tax laws have changed significantly over the years, and some older trust structures may now:
• create unnecessary hassle after a death
• require extra paperwork and maintenance
• create avoidable tax issues later

In many cases, families simply did not know their trust should be reviewed.

If you’re a California resident thinking about how to protect yourself and your family, here’s what I’d want you to know:

1. Being “too young” for estate planning is one of the biggest misconceptions I see. Accidents, medical emergencies, and unexpected situations do not only happen later in life.

2. If something happened to you tomorrow, your family cannot automatically handle everything for you. Without the right documents in place, the people you trust most will likely have to deal with court, delays, or legal obstacles during an already overwhelming time.

3. Estate planning is not just for wealthy people. If you own a home, have children, have savings, or simply want a say in what happens to your life and your future, it matters.

4. The biggest mistake most people make is waiting until it feels urgent. The families I meet with almost always say the same thing: “We thought we had more time.”

If you do not have a will, trust, or written estate plan in California, the State already has a plan for you.

It is called intestate succession.

That means California law decides:
• who inherits your assets
• who receives what percentage
• who has priority to manage your estate
• and sometimes who may be involved in decisions regarding your children

For some families, California’s default plan may align with their wishes. For many others, it does not.

Did you know there is NO public database for California trusts?

A lot of families assume that after someone passes away, they can just “look up” the trust somewhere. But trusts are meant to stay private.

That means if nobody knows where the documents are, finding them can become a major problem.

Here are a few ways families sometimes locate a trust:
• The estate planning attorney may have a copy
• The person may have saved electronic copies
• The deed to the house may show the property is owned by a trust
• Family members may have been given copies

One of the saddest situations I see is when someone spent time and money creating an estate plan, but nobody can find it after they pass away.

A trust only works if it’s properly funded and maintained.
