Naming a Guardian for Minor Children.

Naming a guardian is one of the most important—and loving—decisions a parent can make. I’ve seen this single step hold families back from completing their estate plan. It’s hard to think about, but choosing now means the decision stays with you, not the court.

Keep in mind, a nomination doesn’t grant automatic legal authority. Your guardian will still need to petition the court to be officially appointed.

The court will usually honor your wishes unless there’s a strong reason not to. Setting expectations now makes things clearer and easier for everyone later.

Even if you amend or restate your trust later, that original signing date stays as the title. So, it’s a pretty important date!

Our amazing office manager decided to make her signing date even more special by choosing to sign her trust on her birthday.

🚗 Should You Title Your Car in the Name of Your Trust?

It’s a common estate planning question—and the answer depends on the kind of car.

For your everyday vehicle, we usually don’t recommend titling your car into the trust. Why? Because the DMV has its own process for transferring vehicles after someone passes, and dealing with them directly is often simpler than trying to retitle the car into the trust.

But if you have a valuable car collection or recreational vehicles, it’s a different story. In those cases, we do want to include them in the trust to make sure they’re properly handled and avoid probate headaches.

Estate planning isn’t one-size-fits-all—and that includes how we treat motor vehicles.

What happens if both spouses die at the same time?

It’s not something we like to think about—but when it comes to estate planning, it’s critical to prepare for every possibility.

A well-drafted estate plan doesn’t just cover the expected—it’s there to protect your loved ones when the unexpected happens.

When planning your estate, your attorney should account for scenarios where both spouses pass away simultaneously or within a short period of time. Here are a few provisions to consider:

✅ Simultaneous Death Clause – Automatically designates one spouse as having died first for legal purposes, which can help clarify asset distribution.
✅ Survivorship Deferral Provision – Delays asset transfers to avoid double probate and potentially reduce estate taxes.
✅ “Titanic” Clause – Names a final beneficiary in the unlikely event that all primary beneficiaries die at once.
