⚖️ WIN OF THE WEEK: CASE DISMISSED
This week’s win came after taking a hard look at how the State obtained its evidence.
My client was charged with Possession of Ma*****na, along with several companion charges arising out of the same investigation.
After reviewing the case, I filed a Motion to Suppress challenging the search warrant and the evidence obtained in connection with that search.
Today, the possession case was dismissed — and all companion charges were dropped as well.
Search warrants are not beyond challenge. The government still has to follow the Constitution, establish the required legal basis for a search, and obtain evidence lawfully.
Sometimes the most important part of criminal defense is asking the question:
Should the State have had this evidence in the first place?
This week, asking that question mattered.
DISMISSED. ALL COMPANION CHARGES DROPPED.
