🍀 Stay Lucky This St. Patrick’s Day – Plan Ahead & Avoid OWI Trouble 🍀

St. Patrick’s Day is a time for celebration, but it’s also one of the biggest nights for OWI enforcement. Law enforcement may stop your vehicle for any traffic violation or reasonable suspicion, and once stopped, you may be asked to perform field sobriety tests.

🚨 Know Your Risks:
âś… A breath test result of .08 or higher (.084 with margin of error) = Loss of Iowa driving privileges
âś… Refusing the test = License suspension for twice as long as if you had taken it and failed
âś… Refusal can also be used as an inference of guilt in court

Don’t put yourself in a position where you have to make a difficult decision on the roadside or the station. Plan ahead:
✔️ Designate a driver
✔️ Use Uber, Lyft, or a taxi
✔️ Walk if it’s safe

What are the ramifications of an OWI 1st?

An OWI 1st, also commonly known has a DUI or Drunk Driving, is a serious misdemeanor. If convicted a person faces a mandatory minimum of two days in jail and could receive up to one year. If a breath test is taken it may be possible to defer judgment and avoid a conviction. If a person refuses to breath test the Iowa Department Transportation shall revoked the privilege to operate for one year. If the test result is above .08 a person faces 180 day loss of driving privileges.

The legal community is not immune to the impact current events. Please know that the Iowa Court system is accessible to all regardless of what is occurring. On Monday, the Iowa Supreme Court released additional guidelines pertaining to child custody and visitation orders.

The United States and Iowa is in uncharted waters when in comes to our legal system. The Iowa Supreme Court issued an order continuing all non essential hearings and trials until April 20 (criminal) and May 4 (civil). There are jokes to be made for 4/20 and May the 4th be with you. But in all seriousness regardless of party and politics we all must exercise caution. Caution includes washing hands and limiting contact.

Police and the Courts will continue to function. Additionally, Farnslaw.com will as well. I am proud to have invested into cloud based infrastructure that will allow me to continue to service my community. Hopefully Covid-19 will trail off and our system will of fair access to the courts will quickly come back online.

Recent case resolution: OWI 1st dismissed and drivers license reinstated. The resolution of this case hinged upon knowledge of what is a permissible stop and expected testimony, or lack thereof, of the arresting officer. This result saved the client 1000's of dollars in fines, fees, increased insurance rates, and the cost of a breath testing device. Additionally, the young man can apply for employment and/or grad school with a clean record.

NEWS ALERT: ILLINOIS LEGALIZES MA*****NA, BUT IT'S STILL TROUBLE IN WISCONSIN.

Wisconsin still has a zero-tolerance policy for ma*****na. When a person is arrested for driving under the influence of ma*****na in Wisconsin, blood is tested for a metabolite called delta-9-tetrahydrocannabinol (Delta-9-THC), the active ingredient in ma*****na. It is illegal to use recreational ma*****na in Michigan or Illinois, and then drive back to Wisconsin, if there is any detectable amount of Delta-9 THC in your system!

So, what do you do if you are arrested for a Wisconsin any detectable of THC violation? Is it always a hopeless case? The answer is that even under Wisconsin zero tolerance law, there may be valid defenses. You should have your case evaluated by a qualified attorney.
