On Tuesday, ISBA’s Appellate Section held Dinner with the Appellate Judges, a biannual event providing insight, connection, and conversation through a 2.0 hrs. CLE program, networking hour, and fine dining experience.

What makes this evening so special are the many members of Indiana’s Court of Appeals and Supreme Court in attendance who engage in roundtable discussions and answer questions on the reality, mechanics, and artistry of appellate practice.

ISBA warmly thanks the firm sponsors, judicial guests of honor, and all attendees for making this program so wonderful!

Yesterday morning, Indiana gained its newest attorneys. The new admittees were sworn in under the Oath of Attorneys and affirmed their support for the U.S. and Indiana Constitutions.

We hope you take time to celebrate this well-earned milestone and can’t wait to see the impact you’ll make throughout Indiana’s legal community.

Congratulations all and welcome to the Indiana Bar!

"Today, I want to start with what every lawyer knows about: the courthouse steps," ISBA President-Elect Derrick Wilson shared this afternoon on the steps of Birch Bayh Federal Building. "Every courthouse has them. Stone steps worn smooth by the decades, if not centuries, of use. They are not ornamental. They are not accidental. They are deliberate. Those steps mark a boundary between disorder and order. On one side is the noise of life: conflict, emotion, urgency, power and equality. On the other side is rare in human history: an agreement that disputes will be resolved by rules, evidence, and process, rather than violence."

Derrick joined Chief Judge James R. Sweeney II, Indiana Supreme Court Chief Justice Loretta Rush, and dozens of legal professionals in reaffirming the Rule of Law at the Second Annual Law Day Rally co-presented by the Indianapolis Bar Association and Foundation, ISBA, and others.

It was a powerful reminder to uphold the U.S. and Indiana Constitutions—now, and always—and to promote and demonstrate the fundamental principles of the Rule of Law.

Last week, Class 14 of the ISBA Leadership Development Academy stepped outside the classroom to experience leadership in action.

From driving semi’s and dump trucks at Allison Transmission to a behind-the-scenes look at the Indianapolis Motor Speedway, the class explored how leadership shows up in different industries and environments. (Plus a little friendly competition on the go-kart track.)

Huge thank you to the speakers for this session—Sonja Shah, Chief Justice Rush, and Jimmie McMillian—who shared insights on their leadership styles, the current state of Indiana’s profession, and the responsibilities that come with shaping its future.

Class 14 will wrap up their program with their final session in Jasper this May.

On Wednesday, ISBA and the Marion County Bar Association co-presented The Rule of Law Under Pressure, a Law Day–inspired program examining how foundational legal principles function in today’s climate.

The program featured two sessions that explored:
-the role of judicial and attorney independence in preserving fairness and public confidence, and
-how current federal and state laws shape conversations and decision-making around diversity, equity, and inclusion.

Designed to be fact-based and nonpartisan, the discussions provided clarity, context, and practical insight.

We thank our distinguished speakers and panelists for their thoughtful guidance:

Session One – Rule of Law, Judicial Independence, and Attorney Independence
Chief Justice Loretta Rush • Hon. Tanya Walton Pratt • Professor Joel Schumm • Ken Falk • Moderator: John Maley, ISBA President

Session Two – Legal Framework Governing Diversity, Equity & Inclusion
Professor Cynthia Baker • Kendra Key • Don Smith

Thank you to our partners, speakers, panelists, and attendees for contributing to this timely, important program!

Indiana State Bar Association (ISBA) President, John Maley, wrote a statement on behalf of the ISBA to the Department of Justice on the proposed rulemaking for the Review of State Bar Complaints and Allegations Against Department of Justice Attorneys.

"Regarding the Proposed Rule, our leadership has studied the proposal and considered its potential impact on the admission and discipline of attorneys in Indiana, as well as on the public trust in our system of justice. We respectfully oppose the Proposed Rule, and for three reasons.

First, attorney regulation and discipline are the exclusive province of each jurisdiction’s highest court. In Indiana, our Indiana Supreme Court is entrusted with the admission and discipline of Indiana attorneys. The Court – along with its Indiana Board of Law Examiners and Indiana Disciplinary Commission – has the experience, expertise, skills, training, and authority to regulate all attorneys in Indiana. Principles of separation of powers and federalism would be violated if the Proposed rule were passed. Our state judicial branch is the authority to regulate the conduct of attorneys in our state.

Second, federal government attorneys, just like state and local government attorneys and private practitioners, appear in the same 92 state courts in Indiana and the same two United States District Courts in Indiana. We are all subject to the same Indiana Rules of Professional Conduct; none of us are above the law. This uniformity promotes public confidence in our legal system and preserves respect for the Rule of Law. Departing from that uniform framework risks undermining both public confidence in and the perceived fairness of the disciplinary system.

Third and finally, the Department of Justice – like all other employers of attorneys in Indiana – has the power to instill additional rules and standards on its personnel above and beyond those required by our Indiana Rules of Professional Conduct as administered by our Indiana Supreme Court. But no employer of attorneys in Indiana can impose lesser standards or impede our Indiana Supreme Court’s supervision and regulation of Indiana attorneys regardless of their employer.

In closing, we join and support the Conference of Chief Justices in their public comment. We respectfully urge that the Proposed Rule not be enacted."
