Today the Senate Judiciary Committee heard HB 1436, a bill that in its original form would have required state agencies to pay the attorney fees of parties that successfully appeal agency decisions, including IDEM and DNR permitting and enforcement decisions. The measure was amended to narrow its focus to requiring state agencies to pay attorney fees of an appealing party ONLY WHEN an agency is found to have acted frivolously or in bad faith. While HEC still opposes the bill because it is unnecessary and could still lead to harmful decisions, we are incredibly grateful for this improvement and are so thankful to the grassroots and grasstops engagement that led to this improvement!
