It's been some time since I have posted to this page. That is certainly not because I have been idle. New Building, New Name and New Results. Trial team of Nathaniel Lee and myself, have been putting in the work and obtained seven figure verdicts in our last two trials:

Why Can’t We Be Friends? 🤷‍♂️

I spend significant time discussing with my clients any negatives of their claims and the potential risks they face. Sometimes that bad news can be difficult to digest and I’ve admittedly had clients become upset with my detail of the same. It might be easier if I just pointed out the positive, however as equally important as zealous advocacy is advice of adversarial arguments and their likelihood of success. If you want someone to just tell you what you want to hear, then you are looking for affirmation versus advice. When it comes to litigation, you are probably better off with an attorney and not a friend.

The Internet is without doubt the greatest tool invented for “do-it-yourselfers”. I’ve used it to research everything from shark fishing to chicken coop designs, however the web also has limitations. Looking up symptoms on Web-MD doesn’t make you a doctor and doing a google or wikipedia search doesn’t make you an attorney or an expert. Most injury victims that I’ve met who tried to go it alone, are worse for it. I have a general idea of how my homes septic system works, but I will never attempt to pump the tank myself. I’m wise enough to know that there are jobs you’re better off hiring someone with the training, knowledge and experience to do correctly.

Sometimes accident victims are hesitant to hire counsel as
they claim that they are not “the suing type”. Two questions to ask yourself if you believe that you might not be “the suing type”: 1.) Generally, property owners reap huge benefits by being able to enjoy the outdoors on their property as they desire (Though clearly not with today’s frigid weather. Disclaimer: Don't worry this photo was not taken today!). However, owning property also comes with responsibility. In Indiana, property owners can be held liable for injuries to children (sometimes even trespassing children) on their property due to attractive nuisances. Examples of an attractive nuisance could be unenclosed junkyards, swimming pools, and even trampolines. While most natural conditions, such as a lake or a naturally steep bank, are not considered attractive nuisances, an owner might be held liable for injury if they create or maintain the harmful object.

I've litigated cases and negotiated settlements ranging from merely hundreds of dollars to six figures plus and involving all manner of disputes and all types of injuries from extremely minor to catastrophic permanent injuries and/or even wrongful deaths, however the most difficult job I've encountered is having to mediate between my wife and eleven year old daughter.

Do you have a duty to Clear Ice or Snow? While we haven't had a lot of ice or snow in our area yet, it will happen. You should know your local ordinances regarding Ice/snow removal. For example: According to Municipal Code of Indianapolis(Sec. 431-106) property owners and occupants are responsible for keeping sidewalks clear of snow and ice. So in Indianapolis, if you fail to clear ice and snow on the sidewalk in front of your home or business and then someone slips and falls or worse steps into the road to avoid your treacherous sidewalk and gets hit by a vehicle, then your failure to abide by the code could establish a breach of your duty of care leading to liability for their injuries.

So You didn't win the Powerball? (Odds of approx. 1 in 292,201,338). Well unfortunately, here's some more bad news: Your Chance of Being injured in an Auto Accident are significantly better. U.S. population is approx. 325.72 million people. Approximately 3 million people are injured in U.S. auto accidents each year. (So Odds of approx. 1 in 110). More bad news? Estimates I've seen put Indiana's uninsured motorist rate at 16.7%. (So your odds of being injured in an accident with an uninsured motorist are approx. 1 in 1,837). With medical costs where they are a $25,000.00 minimum coverage policy could barely cover a one night stay in the hospital. Increasing your Uninsured/underinsured motorist coverage protects you from that 16.7% and protects you from "winning" that lottery.

What to Look for in a Personal Injury Attorney!!! Yesterday, I met with a potential new client, whom decided to "explore other options" before signing a contract with me. I was not offended as this is always a good idea and I offered some advice for choosing their attorney whether they decide to hire me or not:
1.) Contingent Fees. All contingent fees are not created equal. Make certain you read the fine print regarding your attorneys fees. While it is commonplace for personal injury lawyers to work on a contingent fee basis (meaning a percentage of the gross recovery), there are some attorneys (whom advertise widely) whom do not charge the more typical 33.33% but instead charge a flat contingent fee of 45%. While this may not seem like a huge difference, after paying the expenses, outstanding medical bills and/or liens, and then 45% to your attorney, said attorney could very well be pocketing a larger sum of your settlement than you do. There are also attorneys whose fee will increase from 33.33% to 40% if they have to file a lawsuit. Again, this sliding fee scale will end up affecting your bottom line.
2.) Access to your Attorney. During the course of representation, you will undoubtedly have questions. Some attorneys rely upon a large support staff of assistants, paralegals, and clerks. Unfortunately, sometimes a large support staff can result in your calls or messages being filtered and/or going unanswered. Make certain you talk to any prospective attorney about their availability. If you can't talk to your attorney directly when you need to, then this can breed distrust and/or contempt in your attorney/client relationship. The most important aspect of representation is communication.
