Uber and Lyft.
A California court just held that uber drivers are employees, not independent contractors. I have been predicting this for a while now.
The new classification is significant. Uber will now be required (after appeals etc.) to pay the employers share of taxes, and be held to all the state and federal regulations concerning employment. Can you see the drivers asking for overtime pay under the fair labor laws? What about lawsuits for wrongful termination, discrimination, workers comp claims.

If you have a company, do not make the mistake of incorrectly classifying the people working for you. . Eventually, you are going to have problems, and the penalties are heavy. Call me, for help on this or any other business issues.

If you are a worker, and you are being paid and treated like an independent contractor, without the protection of labor laws, call me.

My Philosophy

I went to law school to do something, not to be something. I still believe its an honorable profession. My role in society is to be part of the administration of our laws. We resolve our disputes in a civil manner with a third party, the judge. Without laws and our court system, our society would be chaotic.

I am honored, when a person asks me to be their attorney. I know I will make many decisions for them, and give counsel on matters that affect their lives. And they could have hired many other attorneys.

My philosophy is to be an advocate for my client, while providing services and counsel at reasonable rates. My aggressiveness and advocacy will be directed by the client’s needs and desired outcome.

I always tell people to meet an attorney or two and then select the one you are most comfortable with.
