It's your first offense. The charge seems minor. Do you really need to worry?

Even a first-time misdemeanor or low-level offense can have consequences that extend well beyond the courtroom.

Depending on the charge and circumstances, you could face fines, probation, a criminal record, or challenges involving employment, driving privileges, education, and professional licensing.

And while you may be focused on getting through your court date, it's just as important to consider how the outcome could affect your future.

At Brinkley Law, we understand how much can be at stake, even for first-time offenders. Having legal representation can help you understand your options and make informed decisions about your case.

Forming an LLC can provide important liability protections, but those protections have limits.

For example, if you personally guarantee a business loan or lease, you may still be responsible for that obligation even if your business operates as an LLC.

Understanding how your business is structured and what you're personally agreeing to can help you make more informed decisions.

Before signing an agreement that could affect your personal finances, consider having an attorney review the terms.

Expungement can be an important step toward moving forward, but it doesn't necessarily mean every trace of a criminal record disappears.

In Indiana, what happens to a record after expungement depends on the type of case and the applicable law. Some records may be sealed from public access, while others may remain accessible under certain circumstances or be marked as expunged.

Understanding what expungement can actually accomplish for your specific record is an important part of deciding whether to pursue it.

Wondering if your record qualifies and what expungement could mean for you? Contact Brinkley Law to discuss your options.

“Indemnification” is one of those contract terms that’s easy to skim past, but it can have important consequences for a business.

An indemnification provision generally addresses when one party may be responsible for certain losses, claims, or liabilities involving the other party. The exact language matters, and seemingly small differences can significantly change what each side has agreed to.

Before signing a business contract, make sure you understand not only what you’re getting from the agreement, but also what risks you may be accepting.

Have questions about a contract? Brinkley Law can help you understand what you’re agreeing to before you sign.

What does it actually mean to exercise your right to remain silent?

Simply saying nothing during questioning may not always be enough to clearly invoke that right. The U.S. Supreme Court has held that a person may need to clearly communicate that they wish to remain silent. You may also state that you want to speak with a lawyer.

The circumstances surrounding the questioning matter, including whether you were in custody and whether law enforcement was interrogating you.

If you made statements before or after an arrest and are concerned about how they could affect your case, contact Brinkley Law to discuss your situation.
