How do you pay for long-term care needs? Seventy percent (70%) of seniors will need some form of long-term care. Yet Medicare and your health insurance policy will not pay for those costs.
Many assume they must pay for long-term care (LTC) out of their own funds or purchase long-term care insurance. This insurance is a type of policy that will pay benefits when the insured is unable to perform certain activities of daily living (ADLs) such as eating, bathing, dressing, toileting, and transferring.

The need for long term care can last for years. This is true even for residents of nursing homes, the most expensive level of long-term care. According to one study, most nursing home patients will be there for at least a year. In fact, almost 25% will remain patients for more than three years.

Given this, it is cruelly ironic that the need for long term care too often arises suddenly. The lifestyle and independence to which seniors are accustomed can be changed forever without advance notice.
A stroke or a fall are two common ways in which long term needs arise suddenly. The CDC confirms that strokes are a leading cause of serious long-term disability. Seniors make up almost two-thirds of those hospitalized for a stroke.

The statistics are intimidating. According to www.medicare.org, seventy percent (70%) of seniors will need some form of long-term care. Neither Medicare nor the Affordable Care Act will pay for these costs. Nor will the typical health insurance policy. Yet the costs for this care can reach, or even exceed, ten thousand dollars a month.
So many people, even professional advisors, misunderstand how to properly address this risk. Several years ago, I received a phone call from an attorney. He told me about a senior couple he represented. They had approximately $200,000 in assets when the husband suddenly fell chronically ill. He would need long term care. They were obviously worried about how they would pay for his care.

Previously I have written about the heartbreak I see in some seniors who feel as if they are nothing more than a source of money or assets to those who they leave behind when they pass. No estate can exceed the blessing of the lives and lessons we learn from those who came before us. Their values surely exceed their valuables.

One such post elicited a rather poignant response from one woman. Hers was a second marriage, and her current spouse was receding into the fog of dementia. As we discussed her circumstances, she said, “please let his children know I need help.”

More than 65 million people -- approximately 29% of the U.S. population -- are caregivers for a chronically ill, disabled or aged individual. Not surprisingly, the vast majority are unpaid family caregivers.

This heroic effort may be what families do for each other, but its costs are very real. There is help available though, so caregivers and those who need care are both getting the support they need.

For the last several posts I have addressed critical steps for parents who desire to pass on the farm, ranch, or other business to the next generation. Last post, I gave the example in which one child wants to own/operate the business, but the others are not interested. How do you divide the estate? One way is to let all the children have a share of the profits but only one child makes the business decisions.

What if the business does not produce enough profit to divide things this way? First, remember that a “fair” division of the profits is not necessarily the same as an “equal” division. That is a very personal decision specific to each family.

At some point, every family business owner considers what will happen when they are no longer able to run their business. Will they be able to retire when they are ready and successfully pass on the business?
For this to happen, family business owners must identify the specific result they want. Without a specific destination in mind, there is little chance a business owner will end up where they want to be.

Perhaps the biggest challenge is that most parents want to be fair to their children. However, when their children have different attitudes and interests about the business, it is very difficult for parents to define what is “fair”, let alone accomplish a fair result. Nevertheless, if the parents can identify and prioritize the results important to them, there are often multiple options available to achieve these results.

Last post I discussed the challenges facing families attempting to pass on the family farm, ranch, or other business. Family-owned businesses play a critical role in society. Those of us who reside in rural agricultural areas know this to be especially true.

However, a commonly cited statistic suggests that 70% of family-owned businesses do not survive the transition to the next generation. This is an incredible (and I think questionable) statistic. Why would this process result in the end of so many businesses? I am convinced that this result is entirely unnecessary.

Before discussing solutions, it is important to identify the obstacles. In my opinion, the obstacles may be different than what many family business owners think. When I discuss this issue with clients or potential clients, they typically identify concerns over complexity and cost. In reality, this thinking may simply be a symptom of the actual obstacle. This obstacle is the failure to “plan when you can.”

A substantial part of my practice is spent helping families prepare to pass on the family farm, ranch, or other business. Given that this is usually the family’s largest asset, it is critical the process be done properly.

Unfortunately, most family businesses fail to transition to the next generation. However, the likelihood of success dramatically increases when the family prepares for the transition. As the second-generation owner of a firm started by my father more than 50 years ago, and because my daughter is also now part of the firm, I understand the importance of this issue personally and professionally.

An effective plan addresses these unknowns and sets the next generation up for success. Control of the operation is transferred as the first generation is ready to step away and the younger generation is properly trained.
