Channel 48 was the first to request an interview with me concerning the newest appointed case.

The Alabama Law Enforcement Agency arrested Juan Laws and charged him with capital murder after two Huntsville Police officers were shot on Tuesday.

I was disappointed to learn of this yesterday.  This was my second death penalty Capital Murder that went to trial.

In these uncertain times, our Judges are doing the best they can to balance the safety of the community and the rights of citizens. While the entire situation is frustrating for everyone, I do believe that they are trying to keep things moving along to the extent that the virus will permit.

Having tried a case last month in the first round of trials coming out of the original shutdown, i can tell you from first hand experience it was unpleasant, awkward, and felt very forced. I think the delay is a good call, as disappointing and frustrating as it may be for the people awaiting their trials.

After 6 hours of deliberations, the jury returned Guilty Verdicts in the State of Alabama v. Damion Briggs on both counts of So**my in the First Degree as charged in the indictment.

I am beyond disappointed, but understand that when you put the fate of your future in the hands of 12 strangers, that this is a possibility, unfortunately.

The State was not able to secure verdicts on the age requirements to trigger the automatic Life Without Parole sentence, so my client will have his opportunity to secure his release in the future, potentially, depending on what sentence the Judge hands down.

Sentencing is set for December, 2020.

I appreciate the colleagues that showed an interest in this case and the trial, and those that let me bounce ideas off them in preparing for this trial. Tim Douthit of the Madison County District Attorney's Office performed honorably and superbly, as he has in every single trial I have had against him. The citizens of Madison County are lucky to have a prosecutor of Mr. Douthit's ability, character and ethics serve the community.

The jury has the case of the State of Alabama v. Damion Briggs. They were charged immediately before breaking for lunch and will begin deliberation at 1:15p.m.

Mr. Briggs is charged with two (2) counts of So**my in the First Degree of 5 year old. Over my objection, the jury will also get to consider the lesser charge of Sexual Abuse in the First Degree on one of the counts. We objected because strategically the decision was made that it was an "all or none" defense. Our defense was not that the conduct that Mr. Briggs engaged in didn't rise to the level of So**my, but rather, that Mr. Briggs didn't engage in any sexual conduct whatsoever with the little girl.

Today marks the return to what could best be described as "normal" for jury trials. In 45 minutes, I head over to the courthouse to begin trial on the case of the State of Alabama v. Damion Briggs. A scathing 2-count indictment for So**my in the First Degree which will yield Mr. Briggs a mandatory "Life Without Possibility of Parole" sentence if convicted on either of the 2 counts.

Representing the State is the always competent, but always-straight forward, Tim Douthit. Judge Alison Austin has agreed to try the case in the place of Judge Hundley who has a different case beginning trial in his Courtroom. I have tried a handful of cases before Judge Austin, but never had the opportunity to try one in front of Judge Hundley.

The mechanics of a trial are the same. I am ready to do my part to hold the Government to the highest burden of proof that our law imposes in criminal proceedings.

Though a very significant case with very serious consequences potentially in the balance, the case is not a particularly difficult case. It's a straight forward "didn't do it" defense. A "he said/she said", if you will.

The biggest challenge will be the jury composition in these post-Covid times. Who will actually show up for jury duty? Who will want to sit around in a courtroom and pay attention to the details...especially if they have concerns about their safety or family members.

The justice system cannot grind to a perpetual halt, however. Safeguards are in place, and our Judges, their staff, and the Court Administrator's office, Clerk's office, and many others have gone way above and beyond to provide the safest and most effective methods for resuming trials. It's our jobs as officers of the Court to move forward the best way we can in the system that we have been given.

While I have other Capital cases, the case of the State of Alabama v. Warren Hardy is one of mine. The State is seeking the death penalty. We have not received word on exactly when in 2021 we will be reset...but the moving parts to make a trial of this magnitude happen is quite impressive. You really learn to appreciate some of the things you took for granted in the "old days" (Pre-Covid). I know for our Judges and Court Administrator, this is a scheduling nightmare.

As Judge Comer put it best during our last pre-trial conference...he looked over at Mr. Hardy, and said candidly and quite truthfully, "Mr. Hardy...you're trial has been hijacked by the coronavirus". Before having to explain to him that there was no date-certain that could be ascertained. It truly is out of everyone's hands to see how the virus unfolds and when things may get back to closer to "normal".

Jury trials will resume in Madison County next month, but trials for some of the most heinous crimes charged, capital murder cases, will be on hold for the rest of the year.

The trial ended after a very long week in a hung jury and a mistrial being declared. The vote was reportedly 11-1 for acquittal.

Mr. Price's case is now re-set for April 6, 2020 re-trial.

Tomorrow morning at 9:00a.m. I am set to begin a jury trial on the case of the State of Alabama v. James Price. Mr. Price is accused of Sexual Abuse in the First Degree against a family friend, in which the defense is simply that he did not do it. Anna Stinson will be prosecuting for the State of Alabama and Judge Pate will preside over the case. It is anticipated to take a day, and maybe even go into Wednesday, depending on how the flow of evidence comes in. This will be my third straight trial against Anna Stinson.
