No seatbelt during that Houston 18-wheeler crash? Your claim isn't dead.
Texas doesn't automatically bar passengers from recovering damages for being unbuckled. But since the Texas Supreme Court's 2015 Nabors decision, that evidence can be considered.
If not wearing a seatbelt contributed to your injuries, a jury may assign you partial fault. Your recovery gets reduced by that percentage. The real barrier is the 51% rule. Exceed 50% responsibility and you recover nothing.
Someone else's negligence put you in that crash. Their liability doesn't disappear because you weren't buckled.
