Earlier today, the First Court of Appeals issued their opinion in the “Cow Case”—a motor vehicle collision with a cow on on a state highway—securing an appellate victory for Sovany Law Firm and Beard Kultgen Brophy on behalf of their client, Arraby Properties LLC. The appellate court reversed the trial court’s $3.17M judgment in favor of the driver, and rendered a take nothing judgment in its place in favor Sovany Law Firm’s client. In their written opinion, the appellate court agreed that there was no evidence that Arraby owned the cow involved in the accident, let alone that Arraby had a duty to control the cow or prevent its escape from the house in which the parents of Arraby’s owners lived….all assuming that the cow involved in the collision was even the parents’ cow in the first place (a decision that the court did not have to reach).
