On 10/09/2020, H.E. The ambassador of Sri Lanka to the USA, Mr. Rodney Perera appointed our managing attorney Dakshini R. Senanayake, as the Hon. Consul for Sri Lanka in the State of Texas at the inauguration of the Hon. Consul’s office in Houston, TX.

A socially distanced event was held the at the Law office with a few distinguished guests in attendance including Director of Trade and International Affairs of Mayor’s office.

USCIS has returned all fiscal year (FY) 2020 H-1B cap-subject petitions that were not selected in our computer-generated random selection process. On May 17, USCIS announced that it had completed data entry of all selected H-1B cap-subject petitions for FY 2020.

Definitely something we have been seeing in our RFEs. The problem is that most contracts are issued in 6 month or 1 year increments for business purposes, whereas the typical request for the H-1B period is 3 years. That is why is important to supplement the H-1B filing with evidence of sufficient amount of work with other forms of evidence besides the standard contracts.

Companies seeking H-1B workers are being asked to prove they’ll have definite assignments for the full three-year term of the visa, the latest hurdle from the administration in its crackdown on the specialty occupation visa program.

Frequently Asked Question! One of the most frequently asked questions we have receive at our law office involves what is going on with the H4 petition when it is being filed concurrently with an H-1B petition that is being premium processed?

In March 2019, USCIS published revised Form I-539, Application to Extend/Change Nonimmigrant Status, and new Form I-539A, Supplemental Information for Application to Extend/Change Nonimmigrant Status, both with an edition date of 2/4/19. The revised Form I-539 has significant changes, including the requirement that every applicant pay a biometrics fee and attend a biometrics appointment, regardless of age.

With the addition of the new biometric requirement for all I-539 applicants, on March 1, 2019, USCIS indicated during a stakeholder teleconference that USCIS can no longer continue its prior courtesy practice of providing premium processing service to I-539 applications filed concurrently with a qualifying I-129 petition. Rather, I-539 applications are now separated from the I-129 petition and follow the regular I-539 processing queue, as I-539 applications are not eligible for premium processing.

USCIS indicated during the March 1, 2019, stakeholder teleconference that its longstanding courtesy practice of premium processing I-539 applications filed concurrently with a qualifying I-129 petition could not be continued because it generally takes at least three weeks for the I-539 biometrics to be completed, such that USCIS can not meet the 15-day premium processing timeframe.
