Các lập luận của luật sư Kan hiệu quả đến mức tòa phúc thẩm đã đi đến quyết định "đảo ngược và đưa ra" tuyên bố rằng tòa án cấp huyện trước đây đã vi hiến không tuân theo luật và từ quyết định nầy luật sư nhận được một phần lệ phí.
Tòa phúc thẩm cũng đang yêu cầu tòa án huyện giám định những thiệt hại còn lại trong vụ án này.
Sau khi thắng cuộc kháng cáo này, luật sư Kan hiện được yêu cầu thu hồi hơn $130,000.00 tiền bồi thường thiệt hại.

Congratulations to James Kan for winning an appeal in the First District Court of Appeals! Mr. Kan’s arguments were so effective that the Court of Appeals delivered a “reverse and render” decision stating that the lower court failed to follow the law and automatically awarded a portion of the fees. The Court of Appeals is also ordering the lower court to assess the remaining damages in this case. After winning this appeal, Mr. Kan is now set to recover over $130,000.00 in damages.

The First Court of Appeals upheld a jury verdict that we received in 2018. Our client brought a lawsuit against a hospital for wrongful termination after she complained about a lack of security in the hospital. She made this complaint after a person with a mental health condition was struck and killed by a train. Despite her hard work and dedication as a nurse, helping to improve and save lives, the hospital she worked for terminated her. Finally, after four years of litigation and four years of appeal, our firm was able to help our client achieve justice!
