On August 12, Steven O. Grubbs, Bryce Y. Franklin, Alma J. Aguirre, Samuel Perez, and Victor L. Cardenas Jr. of Pappas Grubbs Price PC had the honor of attending the 20th annual Mexican-American Bar Association of Texas Foundation Scholarship Dinner.

Pappas Grubbs Price Associate Sam Perez successfully secured the dismissal of all claims against a client by challenging a plaintiff’s late amended petition.

The case involved a plaintiff who alleged severe injuries during the unloading of a shipment. Shortly before the statute of limitations expired, the plaintiff amended their petition to add our client as an additional defendant. This amendment was filed after the court’s joinder deadline and without obtaining the required leave to add another party to the lawsuit. Attorney Perez successfully argued that the plaintiff’s amended pleading should be stricken from the record due to these procedural violations. As a result, the court dismissed the claims against our client with prejudice, citing that the statute of limitations had already expired.

Pappas Grubbs Price Shareholder Justin Woods recently secured a non-suit for a client in response to a Motion for Summary Judgment.

Three men filed a lawsuit claiming they were injured on separate occasions by bouncers at a bar in Northgate, College Station. Our client, one of the bouncers, was named in the suit. Justin filed a Motion for Summary Judgment, arguing that two of the plaintiffs’ claims were barred by the statute of limitations, while the third plaintiff failed to provide any evidence linking their injuries specifically to our client’s actions. Instead of responding to the motion, the plaintiffs chose to dismiss all claims against our client.

Pappas Grubbs Price Shareholder Justin Woods has successfully argued a Traditional and No Evidence Motion for Summary Judgment, resulting in a dismissal of all claims against Defendants.

The case involved a Plaintiff who tripped and fell over an empty pallet on the floor in front of the check-out counter and sued the Defendants, a large, national convenience store chain, and related entities for claimed personal injuries.

Citing appellate court decisions that have ruled pallets on store floors are not unreasonably dangerous, the Motion argued the Plaintiff’s trip was not caused by a dangerous condition, and Defendants, therefore, had no duty to either move the pallet or warn Plaintiff of its presence. The Court agreed and granted the Motion, dismissing the suit in its entirety.

Pappas Grubbs Price PC Shareholder, Dawn Arney Moore, and Christene Wood, Of Counsel, have secured a final dismissal via summary judgment in a premises liability case representing an apartment complex owner in Brazoria County district court.

The case involved a plaintiff who claimed severe injuries following a fall on the apartment complex grounds. Despite more than two years of litigation, Ms. Moore and Ms. Wood successfully demonstrated that the plaintiff failed to provide sufficient evidence for her claims, leading the court to grant the Defendant's motion to dismiss in all respects.
