RH&A has secured an appellate victory for former Houston Police Officer Felipe Gallegos, who was sued over the 2019 Harding Street raid. The U.S. Court of Appeals for the 5th Circuit has unanimously ruled that Officer Gallegos did not violate the constitutional rights of Dennis Tuttle and Rhogena Nicholas during the raid.

RH&A attorney John MacVane, who served as a principal member of the legal team, authored the brief and argued the appeal before the Fifth Circuit.

“We appreciate the work of the court in reviewing all the facts of this very tragic case. Officer Gallegos was doing what he was trained to do in the most harrowing few minutes of his life. He was protecting his fellow officers and the public and we are pleased that the court has recognized that,” said Mr. MacVane.

Rusty Hardin & Associates attorneys Rusty Hardin, Daniel Dutko, and Joe Roden recently secured a $46 million verdict in a wrongful death case involving an oil field worker in Hays County, Texas. Andrew West was hit by a truck, suffering severe internal injuries and passing away several hours later. “This verdict reflects the jury’s understanding that when someone’s reckless conduct takes a life, there must be accountability,” Rusty said. “No amount of money can bring Andrew back, but this jury sent a clear message about the value of his life.”

Rusty also praised Daniel, saying that, while all three attorneys worked together, it was his “dedication and case preparation that was most responsible for the final result.” Read more: https://bit.ly/3Z1dHTh
