If you’re a Portland-area HOA or commercial property owner with TWIA, those Nov. 1, 2025 hailstorm decision letters are landing—and the deadlines can start running immediately.

Key issues we’re seeing:
• “Accepted” claims that are materially underpaid (often triggering a short window—commonly 60 days—to dispute the amount)
• Multi-building letters that define the claim in ways that can limit what’s covered if not addressed promptly
• Owners who haven’t filed yet—many TWIA losses have about one year from the date of loss to report, and waiting can create serious causation problems if another storm hits

Important: If your claim was “accepted” but underpaid, waiting can cost you the right to recover additional amounts on the accepted portion—in many claims, failing to act within the next 60 days waives your ability to dispute TWIA's determination. If the payment feels low, don’t assume TWIA will “work it out later.”

Groundbreaking IBHS Study Just Changed the Game on Hail Damage

For years, insurers have denied hail claims by arguing that only "severe" hail (1”+) causes damage. But a landmark 10-year IBHS study published today proves otherwise: smaller hail (0.7”–1”) — often overlooked — can cause cumulative and devastating roof damage. The study found that repeated exposure to small hailstones accelerates asphalt shingle aging drastically — in some tests, 2 years of simulated sub-severe hail equaled 10 years of natural wear. Older roofs, already weathered, are 10x more vulnerable to small hail damage.

This challenges outdated insurance models. Building owners should document all hail events, no matter how small, and consult experts post-storm. Small hail isn’t always harmless — it could be quietly shaving years off your roof.

Recent data shows nearly 47% of homeowners’ insurance claims in Texas were closed with no payment in 2024, according to the Houston Chronicle. Even after major weather events like last year’s derecho in May 2024 and Hurricane Beryl, the numbers suggest many policyholders remain unaware that legitimate claims are being underpaid or were wrongfully denied. The underlying Weiss Ratings analysis addressed in the article confirms the harsh truth: 14 major insurers closed nearly half of homeowner claims with $0 payout last year.

Could some of this be due to higher named storm deductibles? Absolutely, but not to this degree in Texas after our 2024 storm activity. Dr. Weiss (the Weiss Ratings founder) apparently agrees, noting that “many insurers appear to be using denials as a strategy to cut back on claims payments" and adding “as tort reform is enacted…it’s often becoming easier for insurers to deny claims with impunity.” Some insurers are clearly rushing to close out storm claims, capitalizing on policyholders who may be too overwhelmed or lack the knowledge to challenge the outcome. Know your rights and read your policy carefully.

Insurers are scaling back the types of damage they cover and raising deductibles, meaning homeowners must pay more to move forward with a claim.

Since the Texas Windstorm Insurance Association (TWIA) has received thousands of claims from insureds after Hurricane Beryl, any policyholders along the coast should be aware of the new rules applicable to disputing TWIA’s claim decision. Be mindful there are deadlines solely applicable to TWIA that, if missed, will BAR any opportunity to challenge TWIA's decision. Courts have even acknowledged the "draconian consequences" for minor deviations by TWIA policyholders, but ultimately recognize they are bound by the statutory scheme in place under Chapter 2210.

For months, some experts have predicted a dangerous hurricane season on the back end of 2024, thanks to La Niña and record warm Atlantic ocean water. This morning, with the start of the 2024 Atlantic hurricane season just over a week away, federal forecasters from NOAA (National Oceanic and Atmospheric Administration) predicted an "extraordinary" season with as many as 25 named storms possible. For perspective, this is the most storms NOAA has ever predicted in a preseason outlook. Specifically, NOAA is forecasting a range of 17 to 25 total named storms (winds of 39 mph or higher). Of those, 8 to 13 are forecast to become hurricanes (winds of 74 mph or higher), including 4 to 7 major hurricanes (category 3, 4 or 5; with winds of 111 mph or higher). All the meteorologists we work with consider NOAA to be the gold standard, due to its peer review, collaboration, and partnerships in its weather research.

While hopefully the Gulf Coast is spared, most people don’t put insurance on their hurricane preparedness checklist. We recently filed suit in New Mexico stemming from a carrier's bad faith partial denial of a hotel owner’s insurance claim for property damage stemming from a pipe burst that destroyed the entire first floor. To add insult to injury, the adjuster chose to use the highest possible replacement cost value (RCV) using incorrect variables, rather than what was required by the policy, to impose a massive 47% coinsurance penalty. Months after making its formal decision on the claim, the carrier even elected to ask for an examination under oath (EUO).
