Back in February, HPD investigators punch-drunk on arresting street racers arrested and charged our client after this fatal accident accusing him and two others of racing and causing death and serious bodily injury. Today, after a careful and thorough investigation and presentation by Brent Mayr and his team of experts, a grand jury returned a "no bill," declining to indict our client and dropping the charges against him. The biggest problem in our criminal justice system is rushing to judgment. Had HPD taken their time on this and looked carefully at all the evidence in this case, they would have seen that our client did nothing wrong. Our client can now move past living under the cloud of two felony charges and the threat of prison time.

We were the first to try a case by Zoom on a DWI in Texas. The judge, prosecutors, and jury were in the courtroom. No camera was allowed on the jury so we tried the case without seeing their faces the entire time. They still acquitted our client. There is no need to put everyone at risk during this tumultuous time, but when we were forced to trial, we still came out on top.

This young man bravely walked back into the Harris County Jail hours ago after Judge Ramona Franklin disregarded what a unanimous panel of justices on the Court of Appeals held. She revoked his bonds regardless and ordered him back into custody. Presumed innocent. Complied with every condition of his bond. And he showed up to court. He couldn’t get into the courthouse today because he’s been at home taking care of his dad who’s sick with COVID and they won’t let anyone in who’s been in contact with someone with COVID. But he sat out in front of the courthouse regardless with Sierra Tabone and listened via Zoom as we tried to convince the Judge to honor her obligation to follow and uphold the law. It was to no avail. Even though bail is not to be used as an instrument of oppression, all she did was oppress him.

So back into the jail he went. He didn’t flee. He didn’t go out and commit a crime. His bond was a promise to comply with the court’s order no matter how wrong it was. And he honored that obligation. In he walked, back to the place where he spent 269 days previously. Who knows how much longer he will be there. But we will keep fighting. Fighting to fix an injustice. Fighting to protect people’s rights.

This young man spent the past 267 days locked up in the Harris County Jail after a judge illegally revoked his bonds. Presumed to be innocent, never convicted of a crime, he missed Christmas holidays with his family, struggled to stay healthy while the coronavirus swept through the jail, and patiently waited while appealed his case. This past Friday afternoon, the Houston Court of Appeals agreed with us, found the judge abused her discretion, and ordered his immediate release.

People talk about fixing the bail system. It just went from being broken in many ways to becoming more broken in other ways. Let's get this right. Start with due process. Give the defendant a hearing with notice and where the rules of evidence apply. Trust magistrates to make smart, sensible decisions. Treat defendants the same. One defendant shouldn’t get a PR/no money bond because their case lands in front of one judge while another similarly situated defendant gets held on a $150,000 bond because it landed in front of a different judge. Most importantly, STOP TREATING BONDS LIKE INSTRUMENTS OF OPPRESSION. It’s the goddamn law and has been for hundreds of years.

Do it like they do with federal criminal defendants. Everyone gets released on bond. Exceptions are made where there is proof of a flight risk or danger to the community at a hearing.

Let’s not make this same mistake again. Let’s get this right.

Based on our discovery of misconduct in the El Paso DPS Crime Lab, the Texas Forensic Science Commission finally concluded that the analyst was professionally negligent. In a “Mueller-esque” finding, they could not “rule out professional misconduct” because the analyst refused to answer questions about her actions. We will continue to pursue this matter to hold her accountable for faking the blood test results of several DWI cases in West Texas.

The Texas Forensic Science Commission voted to approve a final report finding professional negligence against a former state DNA analyst over blood.

Associate Sierra Tabone spoke to the media today after getting a bond set for her client who is accused of making a terroristic threat at University of Houston - Downtown. This is the second student we have represented for making a threat at school this year. Although these threats must be taken seriously, charging young individuals like our client with a felony like this is not the solution.
