Improper Resuscitation of a Newborn Can Cause Brain Damage:

Was your child born with no heart rate, not breathing? If so, your child was likely resuscitated after birth. Brain damage can result from improper techniques used by healthcare providers when resuscitating a baby. The Neonatal Resuscitation Program (NRP) sets the standard of care healthcare providers must meet while resuscitating a baby after birth. For example, the NRP provides that bag and mask ventilation should start within 1 minute of birth and that an alternative airway, like an endotracheal tube, should be inserted shortly thereafter. Medications like epinephrine should also be given within minutes of birth. These standards are used to ensure that the baby receives oxygen and to jump start the baby’s heart. Failure to follow the NRP standards in a timely manner can lead to a catastrophic outcome, brain damage to your child from lack of oxygen and blood flow to the brain.

If your child was resuscitated after birth and has been diagnosed with brain damage, HIE, or cerebral palsy, McGehee ☆ Chang, Landgraf, Feiler may be able to help fight for relief.

Cooling Therapy to Treat Brain Damage in Babies:

Cooling therapy is one treatment that can be used to minimize permanent brain damage in babies after a hypoxic injury (injury due to lack of oxygen) at birth. The treatment must be given shortly after birth/the oxygen-depriving incident to be effective. Cooling therapy involves cooling the baby’s temperature to allow the brain to recover from the brain injury. There are two ways that it can be administered: using a cooling cap for selective brain cooling or by cooling the baby’s entire body.

If your child or a child you know has been diagnosed with HIE, cerebral palsy, or was provided cooling treatment shortly after birth, McGehee ☆ Chang, Landgraf, Feiler may be able to help fight for relief. Call us today!

Judge Lettow issued an opinion for the the Upstream portion of the Addicks and Barker Reservoirs Litigation, Case No. 17-9001L.

Judge Lettow found that the government’s actions constituted a “taking,” and that the government is liable. He further instructed the parties to submit six (6) candidates for an adjudication on the issue of “damages” by January 21, 2020. (this only affects those are part of the “test properties”)

A summary of Judge Lettow’s ruling is below:

“For the reasons stated, the court finds that the government’s actions relating to the Addicks and Barker Dams and the attendant flooding of plaintiffs’ properties constituted a taking of a flowage easement under the Fifth Amendment. Thus, the court finds defendant liable.”

If you or someone you know experienced flooding due to this “taking”, McGehee ☆ Chang, Landgraf, Feiler may be able to help fight for relief. Call us today!

Prolonged Labor and Birth Injuries:

There are criteria and timelines for what is considered the normal progression of labor during the birth process that healthcare providers must follow. If labor progression is delayed or stalled, the medical team should evaluate whether there is prolonged or arrested labor.

In response, medical providers may try a number of different interventions. In any case, allowing labor to continue for too long carries health risks for both the mother and child. Accordingly, if initial attempts to intervene are unsuccessful, medical providers must be prepared to perform a C-section delivery to ensure that harm from prolonged labor is avoided to both the child and mother.

McGehee ☆ Chang, Landgraf, Feiler files claims on behalf of injured children and their families when medical providers, doctors, nurses, and hospitals commit medical negligence during labor and delivery. Seizures can be caused by a number of factors, including hypoxic-ischemic encephalopathy (HIE), infections, birth trauma, and other birth injury. Seizures can also worsen existing brain damage. Accordingly, prompt diagnosis and treatment is always recommended.

Forceps and Vacuum Extractor Injuries at Birth:

Doctors and healthcare providers may use forceps or vacuum extractors during delivery to help get a baby out when delivery is difficult. The medical team may decide that the use of a tool is necessary in order to quickly deliver a baby.

Unfortunately, improper use of such tools can have life-altering consequences and result in permanent brain damage or other injury to a baby. Improper use can also lead to trauma, brain injury, brain bleeding, hemorrhage, and a wide range of disabilities, like cerebral palsy.

If your child or a child you know suffered brain damage or other injury as a result of a healthcare provider’s use of forceps, vacuum extractors, or other equipment, McGehee ☆ Chang, Landgraf, Feiler may be able to help fight for relief. Call us today!

Improper Fetal Monitoring and Birth Injury:

Fetal heart rate monitoring helps medical providers monitor an unborn baby’s health. If the baby’s heart rate is too high, too low, or otherwise abnormal, this can be a sign that the unborn baby is in distress and needs to be delivered immediately via C-section.

Fetal distress can mean that the baby’s body is trying to compensate as a result of being deprived of oxygen. It is considered a medical emergency and should be promptly addressed. If medical providers fail to use fetal heart rate monitors as indicated, use monitors incorrectly, improperly interpret the unborn baby’s heart rate, or fail to intervene when necessary, the consequences can be serious and life-altering.

If your child or a child you know suffered brain damage or other injury as a result of a healthcare provider’s failure to properly monitor the child’s heart rate during delivery, McGehee ☆ Chang, Landgraf, Feiler may be able to help fight for relief. Call us today!

Birth Injuries due to C-sections and Improper Delays in Delivery:

When dangerous health issues are present for the mother or baby, delivery can take place immediately via C-section. There are standards of care in place that doctors, hospitals, nurses and other healthcare providers must follow. For example, an emergency C-section should generally occur within 30 minutes of a decision.

If a baby not getting enough oxygen, a C-section can be performed to protect the baby from brain damage. As it relates to oxygen deprivation, a C-section should be performed as quickly as possible to protect the baby from irreversible brain damage and injuries like hypoxic-ischemic encephalopathy (HIE) and cerebral palsy.

If your child or a child you know suffered an injury due to a delay in delivery, or an untimely or improper C-section, McGehee ☆ Chang, Landgraf, Feiler may be able to help fight for relief. Call us today!
