What is Geographic Restriction?

In Texas, a geographic restriction limits where the children can live. The term is generally found in a custody order. For example, a geographic restriction may state that “PETITIONER” has right to designate the residence of the children within Harris county, and the counties surrounding Harris County. In other words, the petitioner cannot remove the children’s residence from those particular counties.

Parental Kidnapping Under Texas Law – In Texas, parental kidnapping cases are quite common. If a parent or conservator of a child under 18 years old takes the child into his or her physical possession in violation of a court order, the court may cite “interference with child custody.” In other words, it was not your turn to have the child (and a court order clearly stated so), but you took the child anyways without the other parent’s consent.

Uncontested means the parties are not fighting over the issues of the marriage or parent-child relationship (family law). You have both decided how to resolve the conflicts, divide assets and debts, and care for the children. Contested means the parties disagree on one or more issues and may need court intervention.

Let’s start with the Basics.

Engaging the other parent in clear and civil conversations may sound impossible, but it is possible.

** Keep it SIMPLE

Speak less - (stay calm and hear their intent, not the tone)

Impartial - be fair and civil (what if you were in their shoe?)

Mutual Respect - perhaps the hardest after listening, but respect. It is given before earned.

Precise - be clear about your message when you speak

Listen again - in case you did not catch ‘speak less’

Engage - the tone of your voice matters a lot. To engage the other parent, be polite.
