Notary Tip of the Day:

*Are there restrictions on the way an instrument is signed?

The individual signing the document may sign in whatever manner he/she chooses. The name or manner of signing used by the signer is NOT the responsibility of the notary public nor is regulated by state law.

BUT, for loan closings, the notary MUST follow the instructions of the hiring title office or signing service as to how the signer is to sign the documents.

The notary DOES have a responsibility to make sure that the information contained in the notarial certificate is accurate.

For example if John Doe appears before a notary and signs the instrument with an “X” the notary should still state in the notarial certificate that John Doe personally appeared.

In other words, the notary journal should reflect the name of the signer as its presented to the notary, not the method the signer signs.

*The Notary's Signature:

The notary must sign the notarial certificate using the same name that is listed on the notary's commission.

However, as long as the name matches, the signature of the notary may be printed, written, typed, stamped, etc.

NOTARY TIP of the DAY

Did you know that Texas law allows a notary to sign for someone with a disability?

Govt Code 106.0165 allows a notary to sign the name of an individual who is physically unable to sign or make a mark on a document that's presented for notarization IF directed to do so by that person AND in the presence of a witness.

After the notary signs for the disabled person, below the signature line, the notary will then write: "Signature affixed by notary in the presence of (name of witness), a disinterested witness, under section 406.0165, Government Code."

Both parties must be duly identified. Note the circumstances in your journal.

Notary Signing Agent Tip of the Day
TRID = TILA-RESPA Integrated Disclosure
TILA = Truth-in-Lending Act
RESPA = Real Estate Settlement Procedures Act

TRID converged the TILA & RESPA into one integrated form.
TRID created the LOAN ESTIMATE form which replace the GFE (Good Faith Estimate) and the TIL (Truth-in-Lending) Form
TRID also created the CLOSING DISCLOSURE which replaced the TIL and the HUD 1.
Borrowers must receive the Loan Estimate at least 3 days after applying for a loan; the Closing Disclosure must be received at least 3 days before the closing.
The two new forms make it easier for the borrower to understand loan terms, payments, loan costs, and other costs associated with their loan.

TX NOTARY SIGNING AGENT TIP of the DAY:

Upon receiving your loan package, always have the borrowers check the spelling of their names on the Deed of Trust or Security Instrument before signing begins. If misspelled, docs may have to be redrawn.
