To Blended Families:

Without a Will, your assets will be divided according to the law of your state and you lose the right to provide for your spouse and/or any children outside your marriage the way you would like to.

Scenario: You remarry and have a minor child from a previous marriage. You have assets you owned prior to your second marriage which in Texas, would be considered your separate property and you own property with your current spouse which is community property in Texas. if you pass away without a Will or Trust, your surviving spouse would share ownership with your minor child. A guardian would have to be appointed by a court to collect your minor’s assets. The guardian would likely be your ex husband or wife and your current spouse is forced to work with your ex to divide assets. In addition, your ex spouse would be allowed to make decisions about property you and your spouse own on behalf of the minor child. What a mess this would be!!

If this scenario describes your family dynamic, there is a solution. Putting a proper estate plan in place would avoid this disaster. Just one more reason to get it done!

Parents: When your child turns 18, you lose the right to make decisions for them. A proper estate plan can ensure that should something unexpected happen that affects their health and/ or assets, you as a parent are authorized to look out for their best interest. For example, if your adult son/daughter gets sick or injured and cannot make decisions for themselves, estate planning documents will ensure that you have the legal right to protect them. This is definitely important if you have college students. Find out what it takes to put these protections in place.

The biggest misconception:

“I already told my family what I want them to have if something happens to me so I don’t need a will.”

If you don’t know better it’s impossible to do better. This is why ALG is committed to informing and educating in order to prevent the harsh results of this type of misconception. The law of your state dictates how your property will pass at death without a Will. If you have specific property you want to go to specific family members, you have to do a Will. If not, the law may require all assets to be sold if family members decide not to comply with the verbal instructions you gave before death. The law does not protect your verbal wishes.

Question we get asked all the time:

What does probate mean and why is it necessary?

Answer:

Probate is the process of transferring formal and recognized title of your assets to your heirs without a will or to beneficiaries named in your will when you pass away. Whether it is title to a house, funds in bank accounts, vehicles, investment accounts, etc., probate is required if the heirs/beneficiaries want to sell, refinance or collect these assets from 3rd parties. If you have a Will and/or Trust in place, the process is much less expensive for and stressful to your loved ones who are already dealing with grief.

If you have any of the assets mentioned above, there is no time like the present to complete your Estate Planning.

Happy New Year Everyone!

In 2026 I feel like it is my duty to get back to posting about the importance of estate planning because what I have seen this year on the probate end for communities of color who do not plan for the inevitable is really sad. With several estate planning consultations set for next week, it appears that the importance of this is finally being acknowledged but I still want to encourage those who did not prioritize this in 2025 to make it a priority in 2026.
