Good morning all. Angel surviving cancer is looking for 3-4 high school seniors whose mom has either passed from cancer or is currently going through treatment. I am a board member and Attorney for a non profit group, angels surviving cancer, inc. I am reaching out to my network to cordially invite you to our 10th annual prayer breakfast. This event raises funds for scholarships to students whose parent is either going through treatment or who has succumbed to breast cancer. So tried a new hairstylist and she mentioned to me she wanted to build wealth for her daughter and that her and her husband wanted to open her up a bank account.

I STOPPED HER MID SENTENCE.

Don’t do this. Create a trust. Any asset that goes to a child should be in a trust. Why you ask? Great question. (1) Children cannot inherit. (2) you can create a revocable trust (that you control during your life) and can add to it as you see fit. Upon your death you won’t need to do ANYTHING. Everything will already be set up for them. There are many different type of children’s accounts out there but a true is the best way to start building their future for them.

To go or not to go to trial?

Look I know everyone thinks they should “have their day in court” but I’m telling you as an attorney it’s not always worth it. Timewise and moneywise. Did you know that 95% of cases settle outside of court either through mediation or some other settlement relief?

I mean sometimes it’s about principle so I get why you may want to appear before a judge or jury but sometimes you can get what you want if you just ask for it.

I always tell my clients you won’t always win in settling just like you won’t always win in court. It’s about what you can live with. So ask yourself is settling for this something I can live with? Will it make me, hurt me a little, or break me? I always say if it don’t break you it ain’t worth it.

Is it possible to get divorced in 60 days?!

YES YOU CAN!!!

I just emailed a client today that her divorce is final. We filed her case on Halloween of last year. Her 60th day was at the beginning of January this year. Both attorneys were able to come to an agreement without a mediator concerning property. Judge signed it last week.

So no there doesn’t need to be any drama to finalize your divorce if both parties can be amicable and agreeable. In and out. One and done!

Today was a good day.

After three years of fighting, filing endless motions, going to countless hearings, and arguments with opposing counsel, the judge ruled that my client gets to keep her house. She was so excited she hugged me afterwards and thanked me.

I took this case my first year as an attorney and from the start it was endless drama, chaos and lack of cooperation from the other side. I am glad to get a win for my client but this was exhausting and I’m glad it’s over.

Know when you need the right attorney.

A potential client contacted me requesting a real estate attorney. I always question what people say they need cause they are usually wrong about what they need.

In this situation I was correct. She needed a probate lawyer because it concerned real property of a deceased person.

Any time you are dealing with real property of a deceased person you will more than likely need someone who does probate. That is because you will need to take the real property out of the deceased persons name. This requires a probate instrument such as an affidavit of heir ship. In many times you may have multiple interests where someone is contesting. This will most definitely require a probate because the property will more than likely need to be sold so that all may receive their interest.

A lawyer on my timeline asked why aren’t there more marriage attorneys?

There is no such thing as marriage attorney. There really isn’t a thing for divorce attorneys either. The practice is called family law. Family law encompasses all of the following:

Divorce
Marital property
Child custody
Child support
SAPCR
Modifications
Marital agreements
Enforcements
Termination/adoptions
Protective orders/restraining orders

Your family law lawyer should be able to do all of these. If not, throw the whole lawyer away. You cannot claim to practice in a particular area and not know as much as you can about that practice area.
