My client was 25 - life on this felony evading arrest. The final state offer was 5 years in prison. After showing the State the bodycam, it became evident my client was illegally detained. The State agreed to dismiss it, only for the police officer to refuse to listen to the State. He threatened to refile the case if they dismissed it. The State’s answer was for my client to plea to a misdemeanor, we refused because no one should ever plea guilty to something they didn’t do. In the end the State dismissed the case and reported the officer to his supervisor. Police can’t tell lawyers what to do with cases. It is everyone’s job to keep the system honest.

Trial week dismissals! The state charged my client with two serious felonies. The complainant lied during a bond hearing and the State offer him a misdemeanor. He took the plea but on the day of his sentencing told me he couldn’t go through with it because he didn’t do it and that he told me he wanted to plea just because he was tired of coming to court and was worried about the risk of two felonies. I told him he shouldn’t plea guilty to something he didn’t do. We withdrew his guilty plea and set the case for trial. The cases were dismissed the week of trial.

Communicate with your lawyers. The backlogs are taking a toll on everyone, but you should never plea guilty to something you didn’t do. A criminal conviction can follow you around for the rest of you life. Make sure you hire a good attorney and have patience.

Continuous Sexual Abuse of a Child cases carry a minimum sentence of 25 years in prison and up to life in prison. It is one of the most serious charges in Texas and most lawyers won’t even work them. I’ve never understood being alright working some type of crimes but not others as to me, I don’t defend crimes. That’s not my job. I defend people and their rights. I’m not any more ok with domestic violence than I am with child abuse. But everyone deserves a good attorney who cares and looks at their case seriously.

My client spent almost two years in custody with an ICE hold on a case where the complainant admitted she made everything up after a few months in. The system made it to where he couldn’t be release until now. This is why I continue to be an advocate of bail reform and all the good it has done for Harris County. A charge does not mean a person is guilty. And unfortunately sometimes it can take years for someone to clear their name. Our firm had many good results last week! 2 felony dismissals and 4 misdemeanor dismissals.

But our biggest accomplishment last week was getting out client shock probation on both Intoxicated Manslaughter and Failure to Stop and Render Aid Involving Death charges. Intoxicated Manslaughter cases are so hard because there is never an intent to hurt anyone and they are completely avoidable by simply not drinking and driving. These are sad cases that are never easy to defend, but circumstances matter. And in this case my client and I are grateful that a judge took everything into consideration and handed down a fair sentence.

Mental health issues should not turn into criminal cases. Police severely lack training in dealing with people who struggle with mental health. Not every call out to police should end in an arrest. Sometimes people just need help.

This was not a big case by any means, but it was very personal to me. This man was very lucky that so many of the current judges take mental health seriously and show compassion for people. He was also lucky that his cases landed with prosecutors willing to listen. Sometimes people get overwhelmed by their feelings and overreact, but that doesn’t always require an arrest.
