We are proud to share that Kherkher Garcia secured a $1,407,500 verdict on behalf of the Carvajals following a serious bus crash involving Tornado Bus.
This verdict is a reminder of why trial work matters. When cases are undervalued, preparation, persistence, and the willingness to try the case can make all the difference.
In 2022, Mr. Carvajal was driving home from work when a bus made an abrupt lane change, striking his vehicle, pinning it against a barrier, and causing the vehicle to turn onto its side.
This case was litigated for three years, including one unsuccessful mediation. During that time, our clients received zero money offers. Just days before trial, the only settlement discussion involved a hypothetical bracket that would have required our clients to move under $1 million before the defense would maybe offer $350,000.
Kherkher Garcia did not accept that.
Attorney Jesus Garcia handled negotiations for the firm and declined to resolve the case for an amount that did not reflect the value of our clients’ claims.
At trial, the jury found that Mr. Carvajal was not at fault and awarded $1,407,500 in damages, including future medical care and loss of consortium for Mrs. Carvajal.
