The labor market is still so tight. Employers have been telling me for more than a year that they are having a hard time finding workers, especially unskilled labor. Will more (non-West Coast) companies start paying $15 per hr.?

WASHINGTON (AP) — The signs and banners are dotted along suburban commercial strips and hanging in shop windows and restaurants, evidence of a new desperation among America's service-industry employers: “Now Hiring, $15 an hour.”

Indemnification. I think this concept may be the most misunderstood in contracts and why insurance and indemnification should be tied together. Indemnification is when one party agrees to pay for claims or losses of the other party.

In a contract, this typically means a party to the contract (Bob the contractor) is agreeing to pay for losses from claims against the other party to the contract (Betty), which are brought by a third-party (Suzy) as a result of something Bob did.

What if Bob injures Suzy, Suzy sues Betty and Bob, and Bob does not have enough money to pay for the losses Betty incurs from the lawsuit won by Suzy? Suzy is going to come after Betty for the rest of the money. But all Betty did was hire Bob to do a job.

If you're Betty, you want to ensure the contract specifies Bob's indemnification obligations to you and that Bob has adequate insurance to cover your potential losses and pay for your defense from third-party lawsuits like Suzy's.
