Justice Ruth Bader Ginsburg, champion of , died today at age 87, may she rest in peace. A few days ago, she dictated to her granddaughter, “My most fervent wish is that I will not be replaced until a new president is installed.” Her death sets the stage for a political battle over a potential 6-3 conservative majority Court, with Chief Justice Roberts no longer holding the controlling vote that he has occasionally cast with the court’s more liberal wing - e.g., to protect so-called from a.k.a. by the Trump administration (see previous post). This battle will be central to the presidential election and, with lifetime tenure, the Court appointment will in certain ways influence the US legal and political landscape more profoundly than the presidential election itself.
