What is a myUSCIS account, and why should you have one if you're applying for immigration benefits? https://wix.to/OjosXq3

If you are applying for an immigration benefit from U.S. Citizenship and Immigration Services ("USCIS") you want to know about myUSCIS, which is USCIS' online account system. It is quite easy to set up an account with myUSCIS. With a myUSCIS account, you can apply for certain immigration benefits; q...

Hot of the press, the Ninth Circuit decision of Meza Diaz v. Garland includes good language on family-based particular social groups, asylum based on the fear of drug cartels, and the need for all relevant evidence to be considered.

Yesterday, the Ninth Circuit Court of Appeals issued a win for asylum applicants facing a fear of persecution based on cartel violence in Mexico. Not only is this a good decision for the highly complex "particular social group" analysis in asylum and withholding claims, the Court included excellent....

What's in a name? Everything, if you're talking about retail theft and a crime involving moral turpitude. https://wix.to/G8gO1TG

When is theft not a theft offense? When it's retail theft, at least in Pennsylvania. The Board of Immigration Appeals (BIA) finds that Pennsylvania retail theft is not a crime involving moral turpitude, a "CIMT" because, unlike the generic definition of a theft offense, the Pennsylvania retail theft...

The obstruction of justice aggravated felony has been one of the most complex (at least to me)...second only to maybe INA 101(a)(43)(M) (fraud with loss to the victim in excess of $10K). Here, the Fifth Circuit Court of Appeals finds no obstruction of justice aggravated felony for a Louisiana state accessory-after-the-fact conviction, because state law doesn't require that the defendant have the "specific intent" to evade arrest, trial, conviction, or punishment; "general intent" is enough.

I'm so grateful to the Chamber of Commerce Hawaii for selecting Noha Immigration Law as a participant in the first cohort of the Chamber's Impact SmallBiz Accelerator Program. Participants are matched with a mentor, attend seminars on all-things entrepreneurial, and so much more. I could not be more thrilled to have the opportunity to work with my mentor, Edward Ontai, of DataHouse. I have learned so much from him already. Thank you, Chamber of Commerce Hawaii!

It's a stressful time, with more questions than answers. If your loved one is arrested by ICE, is a bond hearing an option? And if not, what are your other options? Check out my blog post https://wix.to/vVqOjVT

Perhaps the most stressful of immigration cases are those where a loved one has been detained by U.S. Immigration and Customs Enforcement ("ICE"). The inevitable first question I hear is: "Can we get a bond hearing?" The person is needed back at work or at home. Unfortunately, the answer to this que...

This week, President Biden announced a new immigration program that would help the spouses of U.S. citizens to obtain green cards (or, permanent residency status), without having to leave the United States. The foreign-born spouse must have been present in the U.S. for ten (10) years prior to June 1...

We were in Chicago for AILA’s 2024 Annual Conference, and took in some of the iconic attractions. Photo on the left from the Field Museum, home of Sue the T-Rex, and on the right my very amateur shot of part of Chicago’s world-famous skyline. I’ve never seen so many architectural styles coexisting in one place.

It’s been a long past few weeks, trying to prepare for tax time and applications to be filed before the USCIS Filing Fee increases on April 1. So grateful for Aloha Friday and this refreshing mango margarita, on the rocks, with salt. TGIF, Everyone!
