about retaliation…What are examples of employer actions that may be considered retaliation?

First, the facts and circumstances of each case determine whether a particular action is retaliatory. For this reason, the same action may be retaliatory in one case but not in another.

So, with that caveat in mind, examples of "materially adverse" actions by an employer may include:

- work-related threats, warnings, or reprimands;
- negative or lowered evaluations;
- transfers to less prestigious or desirable work or work locations;
- making false reports to government authorities or in the media;
- filing a civil action;
- threatening reassignment; scrutinizing work or attendance more closely than that of other employees, without justification;
- removing supervisory responsibilities;
- engaging in abusive verbal or physical behavior that is reasonably likely to deter protected activity, even if it is not yet "severe or pervasive" as required for a hostile work environment;
- making threats of deportation.

Just in case you missed it, today is a National Holiday! Today marks the first observance of Juneteenth as a U.S. Federal Holiday commemorating the end of slavery in America. It'll be the 12th recognized Federal Holiday and will be a "floating" holiday meaning that if June 19th falls on a weekend it will be observed on the closest weekday. The legislation was only signed into law yesterday so some government offices, schools, and businesses will likely be open. The holiday recognizes the anniversary of June 19, 1865 when the emancipation proclamation was finally announced and enforced in all corners of our country. Happy Juneteenth to everyone!
