Subject: November 2, 2024 – Tragic Fatal Semi-Accident-Fire on I-96 - Involvement of DTE and Michigan State Police

Based on the latest apparent information regarding the tragic semi-truck crash and subsequent fire on I-96, November 2, 2024, it appears there were significant failures in adherence to established temporary traffic safety protocols.
The powerline work being conducted on I-96 had been planned in advance. However, it seems that DTE (or their third-party contractor) did not follow the legal requirements outlined under MCLA 257.608 and relevant case law, which mandate the use of the Michigan Manual on Uniform Traffic Control Devices (MMUTCD) for managing temporary freeway closures. Instead of complying with these standards, DTE reportedly contacted the Michigan State Police (MSP) to assist with traffic control. Unfortunately, MSP also did not follow the MMUTCD in responding to the unwarranted request.
Multiple sources indicate that MSP left minimal traffic control measures in place prior to the accident, leaving drivers on I-96 with insufficient warning to navigate stopped traffic on a freeway in this hazardous area given the freeway’s incline and turn. Had the proper procedures been followed, particularly obtaining the necessary permits from the Michigan Department of Transportation (MDOT) and executing a proper temporary freeway closure as dictated by the MMUTCD, this tragic incident likely would have been avoided.
While the driver of the semi-truck bears responsibility for the accident, it is also critical to acknowledge the failures of both DTE and MSP. Both parties contributed to the hazardous conditions that led to this preventable tragedy. DTE and MSP must implement the necessary procedures to stop the random closing of roads and freeways that do not provide the appropriate safety warnings as provided under State Law.
