A Miami-Dade Circuit Court judge denied Citizens Property Insurance Corporation's motion to dismiss a lawsuit and compel arbitration.

Verdict alert! Partners James DeMiles and David Benjamin obtained a $3.3 million dollar verdict in Alachua County in a commercial property damage loss.

This was a covered Hurricane Ian claim where the carrier determined that the damages were below the policy’s applicable deductibles for each of the commercial properties covered under the policy, and the carrier paid our client nothing after they submitted their Hurricane Ian claims.

After presentation of our case we survived Directed Verdict in the dangerous RCV Policy but the carrier will only initially pay ACV trial trap, that causes many cases to fail, for lack of a thorough and complete presentation of the loss.

Despite a repair history that the carrier characterized as old failed roofs to the multiple commercial buildings, and the carrier argued our clients were trying to use their policy to get a windfall, our trial lawyers Jimmy and Dave were able to tell our clients story, persuasively, and get a Plaintiff’s Directed Verdict on one of the carriers key affirmative defenses, improper maintenance of the property, and thereafter obtained a jury verdict of over $3.3 million dollars for our client.
