New Florida law: if your lease is a year or longer, your landlord has to give you a written flood disclosure before you sign, showing any known flood history, insurance claims, or FEMA assistance on the property.

No disclosure and the unit later floods? You can terminate the lease and get your deposit and prepaid rent back. Ask for the form before you sign.

Your landlord kept $900. The repairs cost $400. 🧾

In Colorado, that gap now works against them, not you.

Since January, keeping 125% or more of actual damages is presumed unreasonable, and the landlord must provide proof of actual damages. Tenants can request an itemized written statement along with supporting documentation, and the landlord must provide that within 14 days of a written request.
