PAROLE-IN-PLACE, WAIVERS INFO, AND APPLYING FOR RESIDENCY UNDER BIDEN FAMILY UNITY PROGRAM.

Eligibility:

To be considered for a discretionary grant of parole, on a case-by-case basis, under this process, you must:

Be present in the United States without admission or parole;

Have been continuously present in the United States for at least 10 years as of June 17, 2024;

Have a legally valid marriage to a U.S. citizen as of June 17, 2024;

Not have any disqualifying criminal history or otherwise constitute a threat to national security or public safety; and

Otherwise merit a favorable exercise of discretion.

More information about these eligibility criteria will be available in the forthcoming Federal Register notice.

We may also consider certain noncitizen children of requestors under this process if, as of June 17, 2024, they were physically present in the United States without admission or parole, and have a qualifying stepchild relationship to a U.S. citizen.

AN IMPORTANT MAJOR RELIEF FOR A LIMITED GROUP OF UNDOCUMENTED INDIVIDUALS WHO HAVE BEEN HERE FOR TEN YEARS AND ARE MARRIED TO US CITIZENS. DACA RELIEF, AND HOPEFULLY TPS HOLDERS.

The Secretary of Homeland Security/ USAttorney General may issue Parole-In-Place (PIP) to individuals in the US, a measure that has reportedly used with service members before. This allows undocumented spouses of US citizens to gain legal status and apply for Adjustment of Status to obtain a Green Card, provided they meet other qualifications. Current information suggests a ten-year US residency requirement. PIP is legal and beneficial for those awaiting Provisional Waiver (I-601A) approval and many more. it should assist Dreamers (DACA recipients).The proposed law may not require a waiver like the I-601, avoiding unnecessary burdens. However, limiting relief to spouses of US citizens with ten years of residency is unfair to those married to US Permanent Residents and other single parents of US Children over 21. Advisors should recommend expanding coverage to other undocumented individuals overlooked by the proposed law. President Biden previously promised legalization for TPS holders, who should also be included in this program one way or another. This is not an Executive Order or a law bypassing Congress but a legal exercise of the President authority under existing law. Eligible individuals should apply for PIP immediately after the law's passage and before January 2025. Stay tuned for further instructions on eligibility and application procedures once the program is implemented.

Spouses and minor children of Permanent residents who are legally in the US can file for Adjustment if their priority date is September 2023 or earlier as long as they are in a lawful status and have maintained said status always.
