𝑾𝒉𝒂𝒕 𝒊𝒔 𝒂 𝑵𝒐𝒕𝒂𝒓𝒚 𝑷𝒖𝒃𝒍𝒊𝒄?

Simply put - a Notary Public is a public officer that can legally witness and authenticate documents, administer oaths/affirmations, and perform certain other acts established by law. You usually need a notary when buying/selling a home or when signing a contract or other legal document that requires the verification of your identity.

𝑾𝒉𝒂𝒕 𝒂𝒓𝒆 𝒚𝒐𝒖𝒓 𝒓𝒂𝒕𝒆𝒔?

Legally, a notary public can charge no more than $10 dollars per principal signature and $10 per oath or affirmation of a credible witness. Additionally, I charge for travel* and can meet in a public place should you not feel comfortable meeting at your home. Please see my price chart for more details.
*The maximum rate a notary can legally charge for mileage is $0.65 per mile.

𝑰 𝒍𝒊𝒗𝒆 𝒂𝒏 𝒉𝒐𝒖𝒓 𝒂𝒘𝒂𝒚 𝒊𝒏 𝒂𝒏𝒐𝒕𝒉𝒆𝒓 𝒄𝒐𝒖𝒏𝒕𝒚. 𝑪𝒂𝒏 𝑰 𝒔𝒕𝒊𝒍𝒍 𝒖𝒔𝒆 𝒚𝒐𝒖𝒓 𝒏𝒐𝒕𝒂𝒓𝒚 𝒔𝒆𝒓𝒗𝒊𝒄𝒆𝒔?

Yes, a licensed notary public can notarize documents in any of the 100 counties in North Carolina. A notary can even notarize documents for other states, as long as the actual notarization occurs in the state in which the received their commission.

𝑾𝒉𝒂𝒕 𝒊𝒔 𝒂 𝑷𝒓𝒊𝒏𝒄𝒊𝒑𝒂𝒍? 𝑾𝒉𝒂𝒕 𝒊𝒔 𝒂 𝑪𝒓𝒆𝒅𝒊𝒃𝒍𝒆 𝑾𝒊𝒕𝒏𝒆𝒔𝒔?

A principal is anyone whose signature is required on the document. An individual may seek out a notary if their identity need to be verified in front a witness before signing. In the case of a verification or proof, someone can verify either your identity or signature without the need for a second signature, and thus, another $10 out of your pocket.

A credible witness is someone who is personally known to the notary, that the notary a) trusts to be reliable in confirming the identity of another individual, and b) that the notary believes is not a party to or beneficiary of the transaction.
**For example, John can’t bring his wife as a witness to a mortgage being signed, but he can bring his best friend Joe to verify his identity or his signature.

𝑾𝒉𝒂𝒕 𝒊𝒔 𝒕𝒉𝒆 𝒅𝒊𝒇𝒇𝒆𝒓𝒆𝒏𝒄𝒆 𝒃𝒆𝒕𝒘𝒆𝒆𝒏 𝒂𝒏 𝑶𝒂𝒕𝒉 𝒂𝒏𝒅 𝒂𝒏 𝑨𝒇𝒇𝒊𝒓𝒎𝒂𝒕𝒊𝒐𝒏?

Honestly, only whether or not you are swearing to a deity that the information you are giving to the notary is true. You either “swear to God” (or other deity of your choosing) or you affirm without using the word “swear”.
If there are falsities in either, there is a change a person can be charged for perjury. This goes for the notary as well, so it’s important that these are performed for each and every notarial act and is documented thoroughly.
-Similar to being under oath when you’re in court, but a lot less dramatic!

𝑴𝒚 𝑫𝒐𝒄𝒖𝒎𝒆𝒏𝒕𝒔 𝒔𝒉𝒐𝒘𝒔 𝒕𝒉𝒂𝒕 𝑰 𝒏𝒆𝒆𝒅 𝒂 𝒘𝒊𝒕𝒏𝒆𝒔𝒔 𝒕𝒐 𝒔𝒊𝒈𝒏. 𝑪𝒂𝒏 𝒚𝒐𝒖 𝒔𝒆𝒆 𝒖𝒔 𝒃𝒐𝒕𝒉?

Documents may or may not require the signature of a witness. In the case of a subscribing witness, they will need to be verified using the following criteria:

a) Appears in person before the notary
b) The individual is personally known to the notary or identified to the individual through satisfactory evidence
c) The individual is not a party to or beneficiary to the transaction
d) The individual took an oath or gave an affirmation to one of the following:
i) The individual is a subscribing (signing) witness and witnessed the principal sign the record
ii) The individual is a subscribing witness and the principal verifies his/her signature to the subscribing witness
iii) The individual recognized either the signature of the principal or the subscribing witness on the record as being genuine

𝑾𝒉𝒂𝒕 𝒊𝒔 𝒄𝒐𝒏𝒔𝒊𝒅𝒆𝒓𝒆𝒅 𝑺𝒂𝒕𝒊𝒔𝒇𝒂𝒄𝒕𝒐𝒓𝒚 𝑬𝒗𝒊𝒅𝒆𝒏𝒄𝒆 𝒘𝒉𝒆𝒏 𝒗𝒆𝒓𝒊𝒇𝒚𝒊𝒏𝒈 𝒎𝒚 𝒊𝒅𝒆𝒏𝒕𝒊𝒕𝒚?

At least one current document issued by a federal, state, or federal or state tribal government agency that has a photo of your face and either a signature or physical description of yourself. (e.g. Driver’s License, Passport, Tribal Card.)

-OR-

The oath or affirmation of one credible witness who personally knows the individual seeking to be identified.

𝑰 𝒅𝒐𝒏’𝒕 𝒖𝒏𝒅𝒆𝒓𝒔𝒕𝒂𝒏𝒅 𝒕𝒉𝒊𝒔 𝒅𝒐𝒄𝒖𝒎𝒆𝒏𝒕. 𝑪𝒂𝒏 𝒚𝒐𝒖 𝒆𝒙𝒑𝒍𝒂𝒊𝒏 𝒊𝒕 𝒕𝒐 𝒎𝒆?

Unfortunately, I am not a lawyer, and I legally cannot offer any advice on the contents of a document. In the case of a document being in English and the client only being able to read Spanish, I can translate a few things, but even then it’s a little tricky. The best thing I can do is advice you speak with a lawyer or another type of advisor to explain a document further.
