There are many benefits to owning real estate in the name of a Trust rather than as an individual. One of the many is the ability to sell property quickly after a death. Times surrounding a death are tough enough, and people generally do not want to deal with hurdles and headaches relating to the sale of the deceased’s real estate. If the appropriate language is within a Trust, a successor Trustee will automatically be appointed should the original Trustee die or otherwise be rendered unable to serve in such a role. In this case after a death, we were able to get the property sold quickly while making the transaction smooth for the client during an otherwise tough time.

There are a number of ways that transactions on Cape Cod differ from the rest of the Commonwealth. One big difference comes at a cost to the Seller. As is customary throughout Massachusetts, the Seller is responsible for paying all transfer taxes associated with the sale. For most counties, the transfer tax is calculated as $4.56 per $1,000 in purchase price. However, in Barnstable County, the Seller ends up paying an effective transfer tax rate of $6.48 per $1,000 in purchase price. In the case of a home sold for $1,000,000, the difference between the tax rates is $1,920. This hasn’t seemed to stop Buyers / Sellers from transacting real estate on Cape! However, it is important to let any Seller clients know to expect this difference in their closing costs.

Speed matters in the fast-paced MA residential real estate world! Our average title exam turnaround is 3-5 business days, meaning we are able to handle quick closing timelines and get ahead of any title defects that are discovered in the exam. A prior-owner undischarged mortgage is one of the more common title defects that we see. When the current owner doesn’t have an owner’s title insurance policy, the issue can take weeks to fix. Because we get title back so quickly, and since we also have a dedicated in-house title team to assist with clearing any discovered defects, we are able to keep closings on track at an extremely high rate. We had no issue with clearing up two prior owner undischarged mortgages here!

The clients made a “delayed purchase” - they used a LOC to purchase the home with cash, and then obtained a traditional mortgage on the back end and paid off the LOC. This financing method gives borrowers all the benefits of being a cash buyer while still completing the transaction with financing.
