Today's verdict in Los Angeles, and yesterday's verdict in New Mexico, potentially open up the "flood gates" for claims against the social media companies based on their product's inherent design and algorithms. The legal field is expecting appeals which will ultimately establish case law precedent, and likely result in legislation if the verdicts are upheld. For the moment, these cases involve mental health impacts suffered by children. Everybody who watched Netflix "Social Dilemna" saw the documentary of the hows and whys that social media is so addictive, and we have all experienced impacts within our families and selves. This ruling does not re-instate TPS for Venezuelans in the short term. However, it reflects how the Supreme Court might evaluate the issue when it hears the case, likely this year.

The Trump administration’s termination of humanitarian protections for hundreds of thousands of Venezuelan and Haitian immigrants violated the Immigration and Nationality Act, a federal appeals court found.

The justice system cannot function properly if participants are intimidated to come to Court. Fortunately, detention at Court has not, to our knowledge, been a regular occurrence in our circuit. As attorneys, we oppose any enforcement action at a courthouse except under the direct supervision of a judge when the legal process merits the action.

A group of immigrants and legal advocates have filed a class-action lawsuit that seeks to stop Immigration and Customs Enforcement officers from arresting migrants who appear at immigration courts for previously scheduled hearings and placing them on a fast-track to deportation.

Legislation by executive order has been common, even in the previous administration, with Congress at a log jam on many issues. This results in rapidly changing legal environment for immigration and other matters. Opposition groups forum shop, filing suits in friendly district court venues, resulting in immediate injunctions until the matter processes through the court system. Today's Supreme Court ruling essentially blocked that strategy, such that new executive orders and administration policies, including the impact birthright citizenship, will go into effect immediately until the case challenging the order is resolved on the merits.

The ruling does not decide on the constitutionality of Trump's plan to limit birthright citizenship.
