Hospice bill's information reporting provision raises industry concerns

A couple of provisions in a landmark piece of hospice legislation, still in draft form, are cause for concern among hospice stakeholders. Providers, however, generally believe that, if passed, the bill would modernize the Medicare hospice benefit with much-needed program integrity measures and payment reforms.

One notable concern is the so-called “hospice addendum provision” in the Hospice CARE Act, which would require hospices to provide patients with information related to non-covered services.

Survey tags citing nursing homes continue to run high nationwide

Immediate Jeopardy citations are on pace to either meet or exceed 2023, expert analysis shows. CMS data for the 2023 calendar year shows a total of 6,115 F-689 tags, with 784 rated as Immediate Jeopardy. In calendar 2024 thus far, there have been a total of 2,990 F-689 citations with 406 classified as IJ.

Class Action Litigation Trends in Long-Term Care
Many of these cases have been brought by the same group of plaintiff attorneys primarily in California, Arkansas, Florida, North Carolina, and Washington. They seek high settlements and high plaintiff attorney fees.

The allegations often are “cookie cutter” and it is recommended that providers should mount a vigorous defense. These factually identical allegations include accepting patients who need higher levels of care, misrepresentations in marketing materials, managers who are driven by personal compensation tied to budgeting targets, and failure to consider individual resident needs related to staffing.

Due to the high expense, both in bad publicity and dollars, many senior living facilities are settling prior to class certification. However, defense counsel should focus on the individual resident experience to avoid class action status and reduce exposure. Cloning in EHR can lead to fraud, patient harm
Documentation integrity is critical for avoiding fraudulent billing, HIPAA violations, claim denials, audits and compliance violations, and threats to patient care.

Cloning refers to copying and pasting notes from one patient encounter to another without updating the information. It’s also considered cloning when entries in the medical record are worded the exact same or very similar to previous notations. To meet medical necessity requirements for Medicare, documentation for each provided health service must be distinct from one another.
