IRS Grants Filing and Payment Extensions for Los Angeles County Wildfire Victims

👉 Extended Deadlines for Federal Tax Filings and Payments: Individuals and businesses in Los Angeles County affected by the wildfires now have until October 15, 2025, to meet various tax filing and payment deadlines originally due between January 7, 2025, and October 15, 2025. This includes income tax returns, estimated tax payments, and contributions to IRAs and HSAs for 2024.

👉 Automatic and Manual Qualification for Relief: Taxpayers in Los Angeles County will automatically qualify for relief if their IRS records reflect an address in the affected area. Those outside Los Angeles County, but with records or businesses impacted, can request relief by contacting the IRS Disaster Hotline at (866) 562-5227.

👉 State Tax Relief Pending: The California Department of Finance has not yet announced whether similar relief will apply for state income and franchise taxes. Updates on this matter are awaited.

Immigration Flexibilities for Individuals Impacted by Emergencies and Unforeseen Circumstances

Under certain conditions USCIS will provide relief for individuals navigating through an emergency or an unforeseen circumstance.

Individuals impacted by certain severe weather, such as fires, floods, and other natural disasters, as well as national emergencies, public health emergencies, illnesses, and additional unforeseen circumstances may qualify for immigration relief or assistance.
Individuals living in areas FEMA designated as ‘disaster areas’ should contact USCIS and directly request relief, especially if they have lost any case related evidence or important documents in the disaster.

· The federal government may shut down if Congress does not pass an appropriations bill or a stopgap spending measure by 12:01 a.m. ET on December 21,
· A government shutdown will affect certain immigration services.
· USCIS, ICE and CBP will continue to operate but the DOL’s OFLC will pause processing LCAs, PERMs and prevailing wage requests during the shutdown.

DHS Finalized H-1B Modernization Rule Taking Effect on January 17, 2025

· The final rule revises the definition of qualifying H-1B occupations, allowing more flexibility in degree requirements and clarifying off-site placement provisions.
· USCIS will defer to previous I-129 approvals when the same parties and facts are involved, offering more predictability and reducing the likelihood of RFEs or denials.
· F-1 students looking to transition to H-1B will receive further cap gap protections.
· USCIS’ authority to conduct workplace inspections and enforce penalties will be expanded.
· Starting January 17, 2025, employers must use a revised Form I-129 for all H-1B applications.
