Did you know that there are two forms of custody recognized under Nevada law?
In every custody case, a determination will be made for legal custody, and physical custody.
Legal custody in Nevada is defined as the ability of a parent or guardian to make decisions regarding the health, education, and welfare of a child. These decisions include but are not limited to the child’s schooling, religion, medical care, and extra-curricular activities.
The presumption under statute (NRS 125C), is that parents will exercise joint legal custody of their children, meaning that both parents must consult and agree upon major decisions for the child. Ultimately, the Court will make the decision it feels ensures the best interests of the child will be met.
