🏠 Someone gets hurt at your Airbnb. Are you responsible?

Just because someone is injured on your property doesn't automatically mean you're at fault.

When it comes to an Airbnb or short term rental, one of the key questions is whether the property owner acted reasonably in caring for and maintaining the property. And whether something the owner did or failed to do contributed to the injury.

Simply owning a rental property or having a pool doesn't automatically create liability every time an accident happens.

⚖️ You signed the waiver… so you can’t sue, right?

Not necessarily.

A liability waiver isn't automatically bulletproof just because you signed it. One important issue can be how specifically the waiver describes the risk you're agreeing to accept.

So before assuming “I signed a waiver, there's nothing I can do,” remember that the piece of paper may not necessarily be the end of the story.

🚨 Can a bar be held legally responsible if an intoxicated patron is injured and no one calls for help?

A recent lawsuit is raising difficult questions about where a bar's legal responsibilities begin and end. The allegations include overserving a patron, failing to call an ambulance after a serious fall, and whether businesses have a legal duty to render reasonable aid to their customers.

In Nevada, the law surrounding these situations is more nuanced than many people realize. While bars generally have protections against certain alcohol related claims, that doesn't necessarily mean they're immune from every type of negligence claim.

Where should the line be drawn?

Should bars and restaurants have a legal duty to call 911 when a patron is clearly in distress? Or should the responsibility remain solely with the individual?
