HOW LONG DO YOU HAVE TO BE A NEVADA RESIDENT TO FILE FOR DIVORCE?

One must be a Nevada resident for 6 weeks in order to file a complaint for divorce. This is one of the shortest residency requirements in the United States. Residency is proved with an Affidavit of Resident Witness, who states that he has known the Plaintiff for over six weeks, has seen them on a regular basis several times a week, knows them to be a bona fide resident of the State of Nevada, and that the Plaintiff intends on being a resident for the foreseeable future. Whether one is a resident or not is a question of fact and once established by the trial court will not be set aside by an appellate court unless it is not supported by the evidence.

Many of us are staying home and enjoying time with our families. Many are not. Unfortunately, there is an increase in domestic violence as more people stay home. Victims of Domestic Violence are advised to get a Temporary Protective Order. The Clark County Courts have just provided a link to apply for a protective order. This is the link:

Divorces continue to be processed by the Courts. Last week we did a prove up and got a couple divorced. The parties appeared by telephone and video link. One person was in their car. Like other fields the practice of law is adapting to working under the current restrictions. If you have any legal questions my number is 705.966.8270.

In these times of non essential businesses being closed, the Courts are still moving cases along. Last week we had an adoption. At an adoption hearing, the adoptive parents, the child and the attorney personally appear in front of the judge. The adoption last week was different. The court sent me a link so that the child and parents could remain home and appear via video link, I was in my office appearing via video link and the judge and his staff were in the court room. The adoption went off with out a hitch and everyone was happy.

The courts have always had the ability to do video hearings. It is only with the pandemic that video hearings are being done as a matter of routine.
