Being in Immigration Court does not automatically mean a green card is out of reach. 🇺🇸

Some people may qualify for adjustment of status before an immigration judge. Eligibility depends on your immigration basis, visa availability, entry history, admissibility, and which agency has jurisdiction.

An approved I-130 does not automatically end removal proceedings—and marriage does not fix every immigration issue.

Your court strategy, USCIS filings, and supporting evidence must work together. Keep every deadline and attend court unless excused.

🚨 BREAKING IMMIGRATION NEWS: BIA OVERTURNS LONGSTANDING U VISA CONTINUANCE PROTECTION!

A significant change in immigration court procedure could affect individuals seeking U visa protection while facing removal proceedings.

On October 16, 2026, the Board of Immigration Appeals (BIA) reportedly issued Matter of L. Ramirez, 30 I&N Dec. 157 (BIA 2026), addressing continuance requests involving pending U visa petitions.

⚖️ WHAT CHANGED?

The reported decision overturns Matter of Sanchez Sosa, which established a rebuttable presumption favoring a continuance when a respondent demonstrated that a pending U visa petition was prima facie approvable.

Under the reported new approach, Immigration Judges must evaluate continuance requests using the good-cause framework established in Matter of L-A-B-R-.

WHAT DOES THIS MEAN FOR U VISA APPLICANTS?

🔹 A pending U visa petition does not automatically guarantee that immigration court proceedings will be delayed.

🔹 Immigration Judges consider factors such as the likelihood of USCIS approval, the effect of that approval on removal proceedings, and the respondent’s diligence.

🔹 Attorneys must present individualized legal arguments and supporting evidence demonstrating good cause for a continuance.

🔹 A continuance may still be granted when the applicable legal standard is satisfied.

⚠️ IMPORTANT: A pending U visa petition does not, by itself, provide protection against removal.

BOTTOM LINE: If you have a pending U visa petition and are in immigration court, your legal strategy matters. Proper documentation, timely filings, and persuasive arguments may be critical to your case.

At L. P. Taylor Law, we believe informed clients are better prepared to protect their immigration interests.

Abuse should not leave you feeling trapped—especially when you’re facing deportation.

VAWA cancellation of removal may allow certain survivors of battery or extreme cruelty by a U.S. citizen or lawful permanent resident spouse or parent to seek a green card in immigration court.

Eligibility involves specific requirements, including physical presence, good moral character, and qualifying hardship. This relief is different from a VAWA self-petition.

🚨 GREEN CARD LOTTERY UPDATE: WILL DV-2027 REGISTRATION OPEN BY OCTOBER 18?

Reports circulating online claim that a federal court has ordered the U.S. Department of State to open registration for the Diversity Visa (DV-2027) Program by October 18, 2026.

⚠️ IMPORTANT: This reported deadline has not yet been independently verified against an official court order or State Department announcement.

🇺🇸 WHAT IS THE DIVERSITY VISA LOTTERY?

The Diversity Immigrant Visa Program provides an opportunity for eligible individuals from qualifying countries to apply for immigrant visas through a random selection process.

WHAT APPLICANTS SHOULD KNOW:

🔹 Registration dates must be confirmed through the U.S. Department of State.

🔹 Applicants must meet the applicable country-of-eligibility and education or work-experience requirements.

🔹 Selection in the lottery does not guarantee a green card.

🔹 Applicants should use only the official registration website: dvprogram.state.gov.

Do not pay third parties claiming they can guarantee selection or early registration.

📢 IMMIGRATION UPDATE: USCIS FEE INCREASES TAKE EFFECT TODAY — OCTOBER 16, 2026!

U.S. Citizenship and Immigration Services (USCIS) has implemented inflation adjustments to certain immigration fees established under the One Big Beautiful Bill Act (OBBBA).

⚖️ HERE’S WHAT YOU NEED TO KNOW:

Effective October 16, 2026, the following fees have increased:

🔹 Annual Asylum Fee: $102 → $105

🔹 Initial Employment Authorization (EAD): $560 → $570 for specified asylum, parole, and TPS categories.

🔹 Temporary Protected Status (Form I-821): $510 → $520

🔹 Immigration Parole Fee: $1,020 → $1,050

⚠️ IMPORTANT: These adjustments do not apply to every immigration application or every Form I-765 or I-131 filing. The initial Form I-589 asylum application fee remains $100.

WHY DOES THIS MATTER?

Submitting an application with an incorrect filing fee may result in rejection, processing delays, and potentially serious immigration consequences.

Applicants and attorneys should verify the applicable fee before submitting immigration documents.

BOTTOM LINE: Immigration fees continue to change. Staying informed and filing correctly are essential to protecting your immigration process.

Subject to the J-1 two-year home-country residence requirement? You may qualify for a waiver. 🇺🇸

Five possible bases include:

• A home-government No Objection Statement
• An interested U.S. federal government agency request
• Persecution based on race, religion, or political opinion
• Exceptional hardship to a U.S. citizen or lawful permanent resident spouse or child
• The Conrad State 30 physician program

Each has specific requirements. Marriage alone does not establish exceptional hardship, and a No Objection Statement does not guarantee approval.

An approved waiver addresses the § 212(e) requirement—it does not itself grant a green card, lawful status, or work authorization.

A J-1 visa opens the door to exchange opportunities—but understanding the rules matters. 🇺🇸

Your program category determines what activities and employment are permitted. Some J-1 visitors are also subject to the two-year home-country physical presence requirement under INA § 212(e), which can affect future immigration options.

Marriage to a U.S. citizen does not automatically remove that requirement. Depending on your circumstances, you may need to satisfy it or obtain an approved waiver before receiving a green card.

Know your program rules, keep your DS-2019 records, and review your options before your program ends.

📢 IMMIGRATION UPDATE: USCIS CHANGES FORM I-129 FILING ADDRESSES!

Effective October 7, 2026, U.S. Citizenship and Immigration Services (USCIS) updated the filing addresses for certain Form I-129 petitions, Petition for a Nonimmigrant Worker.

Form I-129 is used by employers and petitioners seeking to classify foreign nationals in various nonimmigrant categories, including H-1B, L-1, O-1, and R-1.

⚖️ WHAT YOU NEED TO KNOW:

🔹 New Filing Addresses: Petitioners should review the current USCIS direct filing instructions before mailing Form I-129.

🔹 Transition Period: USCIS will continue accepting affected petitions sent to previously designated addresses if postmarked on or before November 9, 2026.

🔹 Updated Form Edition: Beginning November 9, 2026, USCIS will accept only the 09/09/26 edition of Form I-129.

🔹 Avoid Rejections and Delays: Using an outdated form edition or incorrect filing address may result in a rejected petition, potentially affecting important immigration deadlines.

⚠️ IMPORTANT: This is an administrative filing update, not a new immigration law. However, failure to comply with USCIS filing requirements can have serious consequences.

BOTTOM LINE: Before submitting an H-1B, L-1, O-1, R-1, or other Form I-129 petition, confirm the correct filing address, required form edition, supporting documentation, and applicable fees.

At L. P. Taylor Law, we believe staying informed is part of staying prepared.

Have a marriage-based two-year green card? Your spouse’s signature may not be required to remove the conditions on your residence.

You may qualify to file Form I-751 without your spouse based on:

• A good-faith marriage that ended in divorce or annulment
• A good-faith marriage involving battery or extreme cruelty
• Extreme hardship if your status is terminated and you are removed
• The death of your petitioning spouse

The first three are waiver grounds. A spouse’s death allows an individual filing.

Each option has specific requirements. Separation or a spouse’s refusal to sign alone does not establish a waiver. Your evidence and filing timing matter.

📬 Received an FBI privacy notice from USCIS? Here’s what you should know.

The letter titled “FBI Privacy Requirements for Biometrics Collection by USCIS” explains how your fingerprints and other biometric information are used for background checks and ongoing immigration vetting, along with your privacy rights.

⚖️ This is NOT a Notice to Appear in immigration court. A Notice to Appear—Form I-862—is a separate document related to removal proceedings.

Receiving this privacy letter alone does not mean you are under investigation, your case has been denied, or an approval is coming.

✅ No response is required for this particular privacy notice. Keep it with your records and send a copy to your attorney. Continue following any separate USCIS requests, appointments, or deadlines.

Always review the actual notice—every USCIS letter deserves attention.
