If you passed away today, do you know what will happen to your assets?

Do you have children? If you answered yes, do you know for certain who will take care of your children in the event that you passed away? Even if you have a verbal agreement with someone, it may not hold up in the event of death. Someone else can contest guardianship, without proper documentation of your wishes.

When someone passes away, inheriting their property is not necessarily automatic. For instance, if an individual owned a home and it was their name solely on the deed, without going through the probate process, their descendants do not automatically inherit the home. Similarly with bank accounts, if there is no one else listed on the account or there is no one listed as a "Paid on Death" beneficiary, then the individual's estate will need to be probated before their descendants can have access to the accounts.

Did you know ... If you pass away WITHOUT a Will, your spouse can inherit the first $50,000 of your assets and 1/2 of your remaining estate and your children can inherit the remaining 1/2 of your estate to share. For many people, they would want their spouse to inherit 100% of their assets, however, without a Will, there is no guarantee that will happen.

Let's talk about Divorce....

Getting a divorce can be one of the most stressful events someone goes through in their lifetime. It's expensive, messy, and emotionally draining. You may think that once the divorce is finalized, that you are done. BUT, if your Will named your former spouse as a beneficiary, the divorce does not negate your Will. You will need to draft and execute a new Will. If you don't, your former spouse can inherit your assets upon your death.
