I recently spoke to a friend who received an inheritance from her mother’s estate. Part of this inheritance was an IRA but the financial company did not withhold any taxes from the distribution. If she did not seek further advice from her accountant this could have caused her family a major issue with the IRS.

On this day in 1937, Lou Gehrig ended his holdout with the Yankees, agreeing to a $36,000 contract and a $750 signing bonus—making him baseball’s highest paid player. Here’s my painting of him with New York in 1936, the year in which he won MVP honors and led the Yanks to their first post-Ruth title. Painting is based on the amazing work of Charles Conlon, and remains one of my favorite images of the man.

When people ask me what documents are crucial in estate planning, my response is always the same. Anyone who is over the age of 18 must have a Financial Power of Attorney. This document will allow someone to sign your name for you when you are legally unable to do so yourself, usually because you have been deemed incapacitated. We have seen many times the catastrophic consequences families must deal with because an incapacitated person lacks this document. What good is fire insurance if your house burns down and you don’t have it? Can you go get the insurance after the house burns down? Of course not. And that’s the problem with a Financial Power of Attorney. If you need and don’t have it, there is nothing that can be done . It’s too late. Now, let’s hope we don’t get too much snow today…

When I first become acquainted with someone, as soon as they understand I am an estate planning lawyer he or she almost always asked in short order “Nathan, I really need a will, don’t I?” I am thrilled when I get this question because my answer is always, “not necessarily.”

The truth is, wills are of limited use in most peoples’ estate plans. Once someone understands the true function of a will, many determine a will is not all that crucial.

Paul’s Background

Paul C. Nylen is currently the managing partner of Nylen & Partners, LLC (N&P). Prior to founding N&P he practiced international tax at Deloitte Tax, LLP in Milwaukee, WI. He is a graduate of Marquette University Law School and is a licensed attorney in the state of Wisconsin. Prior to law school he graduated from the University of Iowa with a master degree in accounting (taxation emphasis). He is currently a licensed CPA in the state of Wisconsin. In addition to his duties at N&P, he is an Assistant Professor of Accounting at the University of Wisconsin - Whitewater. At Whitewater he teaches undergraduate and graduate courses in tax, tax research, and international tax. His research articles have been published in: Tax Notes, Tax Notes International, the Houston Business and Tax Law Journal, the International Tax Journal (CCH), The International Tax Review, the Bulletin for International Taxation, and the Akron Law Review.
