How important is the SCOTUS decision in Harrington v Purdue Pharma? Obviously huge for those who had hoped that the confirmed chapter 11 plan would provide closure and payments. But, I am more concerned for how the decision will impact future mass-tort cases.

I have worked on large complex chapter 11 reorganizations, including those dealing with mass-torts since 1986. I have seen first hand how channeling injunctions and third-party releases actually get negotiated and how the process can be used to minimize harm to victims of mass-torts.

When mass tort cases create legions of claims from victims represented by plaintiffs' lawyers, there is often a very real risk of an unsustainable "race to the courthouse." Some lucky victims may recover extraordinary amounts of money, but many others will recover nothing.

In each case, the problems were created before the company filed for bankruptcy. The judges, their staff, the bankruptcy lawyers, and the other professionals each play a role in a complex process that is intended to balance the competing interests of stakeholders to reach a confirmable plan consistent with the mandates of the United States Bankruptcy Code.

While the problems that are addressed in Chapter 11 Reorganizations are difficult, there have been two constants that have made it an honor to practice before our bankruptcy courts: 1) Our judges are very bright, have years of highly relevant experience in this complex practice area, and consistently demonstrate integrity, thoughtfulness, and compassion; 2) The overwhelming majority of attorneys who practice within the bankruptcy bar are highly skilled, capable, principled, professionals (that is not to say that lawyers within the bar do not disagree strongly about issues, zealously advocate for our clients, ask judges to reconsider rulings or take appeals when we disagree with a decision).

For the reasons articulated in the dissent by Justices Kavanaugh, Sotomayor, and Kagan, I believe that the Harrington v Purdue decision was wrong, rewrites the text of the United States Bankruptcy Code and restricts the long-established authority of the bankruptcy courts to fashion fair and equitable relief in mass-tort cases.
