HOW A STATUTE OF LIMITATIONS WORKS

A statute of limitations is a law that sets a time limit for a cause of action. It sets the maximum amount of time that a party has to file a claim for legal proceedings. The statute of limitations is different depending on the offense and even varies between states for the same offense.

It’s important to speak to an attorney at the earliest time available after an incident so that he or she can begin legal proceedings in order to toll the statute. Many clients that have been the victims of medical malpractice come into our office for incidents that have occurred past the statute of limitations for medical malpractice actions in Pennsylvania and sometimes there is nothing we can do on their behalf.

Further, it’s important to give your attorney enough time to research your issue. For example, in a medical malpractice action the attorney needs to gather medical records, speak to experts, and research case law before filing a complaint. This process can take several months and many attorneys do not like to take a case that has a statute running out within the next six months.

We don’t love irresponsible owners.

According to a study from the CDC, approximately 4.7 million dog bites occur in the United States each year, and 800,000 of those bites result in medical care. The U.S. population is approximately 325.7 million people as of 2017. That means a dog bites 1 out of every 69 people.

Most dog bites involve dogs who are not spayed or neutered. It’s important to not encourage your dog to play aggressively.

Remember that any dog can bite, no matter how well-trained it may be. So it is always a good idea to be a responsible dog owner and make sure pets are supervised at all times with others.

The risk of getting into an accident increases during the summer months. Here’s why:

There are more drivers on the road. Summer is peak driving season for road trips, family vacations, motorcyclists, and all these combine to create more congestion on the road which increases the chances of getting into an accident.

Inexperience drivers increase in the summer months. School’s out (for summer!) and a higher percentage of teenage drivers hit the road.

1. The Law is Complicated

If you’re not a lawyer you probably have no business acting like one in certain instances. Even experienced lawyers typically do not represent themselves in court. Also, attorneys tend to specialize in one or more legal practice areas, such as criminal defense or tax law.

A solid case can quickly unravel without the help of a trained and emotionally detached attorney. Similarly, failing to hire a lawyer when starting a business, reviewing a contract, or embarking on other endeavors with potential legal ramifications can result in otherwise avoidable pitfalls.

2. Not Having a Lawyer May Cost You More

What’s at stake? A criminal case may determine whether or not you spend time behind bars, while a civil case could hurt you financially. Besides, there are many civil attorneys who don’t actually collect a dime from you unless they win your case. Also, you may be able to claim legal fees as a plaintiff in a civil case, so hiring a lawyer can actually save or make you money.

What Should You do After a Car Accident?
Follow these steps to help protect yourself and your family after a car accident.

1. Ensure everyone’s saftey and immediately call emergency personal to assist. Set up flaires or cones to help protect the scene from other motorists.

2. Call the police. It’s always best to get a police report of the accident. If the accident occurs on a state highway, you must request the report from the state police. Otherwise, you should call the local police department who handled the report.

3. Exchange information with the other driver. Always obtain information about insurance from their insurance card and exchange contact information.

3. Document the accident by taking pictures and getting the other driver’s information. If you have visible injuries, photograph those as well.

4. Go to the hospital if you are injuried. Some injuries are not immediately apparent. Often, soreness and stiffness are symptoms of other injuries. It’s important to have a doctor provide a medical assessment if there are future injuries that are caused by the accident.

5. Report the accident to your insurance company. Your insurance policy may provide a car rental service or pay medical bills. It’s important to understand what expenses your insurance will cover.

6. Protect your rights by consulting an attorney. Insurance companies have teams of lawyers and professionals that may contact you after an accident. Your attorney can better advise you of your rights and esnure you are fully compsentated for your vehicle or any work loss that you may have suffered.
