Marital debt generally includes obligations incurred during the marriage, such as credit cards, mortgages, car loans, and personal loans, regardless of whose name is on the account.

The court considers several factors, including each spouse’s financial circumstances, contributions to the marriage, and the overall division of property. In some cases, one spouse may be assigned more debt to balance the division of assets.

It is important to understand that even if a divorce decree assigns a debt to one spouse, creditors are not bound by that order. If your name remains on the account, you could still be held responsible by the lender.
