Where Should a Child Custody Case Be Filed in Alabama?

That question can shape the entire case.

In a recent published decision, the Alabama Court of Civil Appeals clarified that venue in a child custody action must be based on objective facts — not on one parent’s belief about where a child “lives.”

In Alabama, venue is determined at the time the case is filed and depends on:

• Physical presence
• Intent to remain

If a parent relocates shortly before litigation begins, the court must apply a proper domicile analysis — not assumptions.

Procedural issues like venue may sound technical, but they can significantly impact how a custody case unfolds.

Divorce has a way of making even disciplined, rational people say:

• “I just want this to be over.” 😖

We see it every week.

That urge — to be done at any cost — can quietly push people into decisions they’ll live with for years.

Around our office, we call it the Done Monster.

It convinces you to:
• Give up more than you should
• Settle parenting terms that won’t hold up
• Save a few thousand dollars now and lose far more later

Here’s the hard truth:

Ending the case doesn’t eliminate anxiety.
It just changes its source.

The better question isn’t “How fast can I get out?”

It’s “What outcome will I still respect five or ten years from now?”

High-Conflict Co-Parenting Lessons from Dr. Martin Luther King Jr.

On Martin Luther King Jr. Day, it’s worth remembering that Dr. King wasn’t passive—he was disciplined. That distinction matters in high-conflict co-parenting.
Three lessons his example offers parents navigating constant conflict:

1️⃣ You can assert yourself without aggression. Calm firmness is harder—but far more effective—than emotional escalation.

2️⃣ Standing up for yourself carries short-term consequences. Pushback, retaliation, or discomfort often show up before stability does.

3️⃣ “We must learn to live together as brothers or perish together as fools.” In high-conflict co-parenting, unresolved hostility doesn’t disappear—it gets passed to the children.

If you’re dealing with a difficult co-parent, ongoing custody disputes, or repeated conflict, this is the work: boundaries without bitterness, resolve without rage, and long-term thinking over short-term reactions.

📌 High-conflict doesn’t require high emotion. It requires leadership.

Which is exactly why court orders exist — to bring structure, fairness, and stability for kids.
